Probable cause affidavit: |
SUBMITTED BY: POLLARD, RANDALL 0677 (AR11119194) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). DID KNOWINGLY ATTACH TO ANY MOTOR VEHICLE OR MOBILE HOME ANY REGISTRATION LICENSE PLATE, OR WHO KNOWINGLY ATTACHES ANY VALIDATION STICKER OR MOBILE HOME STICKER TO A REGISTRATION LICENSE PLATE, WHICH PLATE OR STICKER WAS NOT ISSUED AND ASSIGNED OR LAWFULLY TRANSFERRED TO SUCH VEHICLE, IS IN VIOLATION OF FLORIDA STATE STATUTE 320.261. ON 020511, WHILE CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF GODFREY DRIVE AND HIGHWAY 19, I OBSERVED A RED FORD ESCORT RUN THE STOP SIGN LOCATED AT GODFREY DRIVE AND LINDBERGH STREET. THAT VEHICLE WAS HEADING EAST BOUND ON GODFREY DRIVE AND UPON ROLLING THROUGH THE STOP SIGN, IT TURNED NORTH BOUND ON TO LINDBERGH STREET. AT THAT TIME, I FOLLOWED THAT VEHICLE TO THE AREA OF LYRICAL LANE, AT WHICH TIME, I CONDUCTED A TRAFFIC STOP ON THAT VEHICLE. UPON MAKING CONTACT WITH THE DRIVER, MR THOMAS PURNELL, IN ASKING FOR HIS DRIVER'S LICENSE AND PROOF OF REGISTRATION, HE STATED THAT HE WAS NOT GOING TO LIE TO ME HE DOES NOT HAVE A DRIVER'S LICENSE AND THE TAG THAT IS ON THE ESCORT DOES NOT BELONG TO THIS VEHICLE. AT THAT TIME, I OBTAINED THOMAS' INFORMATION. I RAN HIM THROUGH "D.A.V.I.D." AND CONFIRMED THAT HIS DRIVER'S LICENSE WAS NOT VALID. PER "D.A.V.I.D.", IT SHOWED A STATUS OF REVOKED. THE TAG THAT WAS LOCATED ON THE VEHICLE DID NOT BELONG ON THAT VEHICLE BUT RATHER TO A WHITE LINCOLN FOUR DOOR. I INFORMED THOMAS I WOULD BE PLACING HIM UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED (DWLS/R) WITH KNOWLEDGE AND FOR ATTACHED TAG NOT ASSIGNED. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THE VEHICLE THAT THE DEFENDANT WAS DRIVING WAS LESS THAN 50 FEET FROM THE DEFENDANT'S DRIVEWAY. HE REQUESTED THAT THE VEHICLE BE PARKED THERE SO THEREFORE IT DID NOT HAVE TO BE TOWED. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE AT THE DETENTION FACILITY, HE WAS ISSUED THREE FLORIDA UNIFORM TRAFFIC CITATIONS (UTC), NUMBER 6597-FRY-X, FOR RUNNING THE STOP SIGN AT LINDBERGH AND GODFREY WITH FINE OF $166.00 PAYABLE IN 30 DAYS. UTC NUMBER 6598-FRY-X FOR DWLS/R WITH KNOWLEDGE WITH A MANDATORY COURT DATE OF 022411 AT 1300 HOURS. UTC NUMBER 6599-FRY-1 FOR ATTACH TAG NOT ASSIGNED WITH A MANDATORY COURT DATE OF 022411 AT 1300 HOURS. THE DEFENDANT'S BOND WAS SET AT $750.00 PER THE BOND SCHEDULE.
