Probable cause affidavit: | SUBMITTED BY: RUSSO, CAROLYN N236 (AR13-5780) did drive or was in the actual physical control of a veSSEL while under the influence of alcoholic beverages, model glue or any substance controlled under Chapter 893 or Chapter 877.111 to the extent HIS normal faculties were impaired, in violation of Florida Statute 327.35(1)(A) On May 26th, 2013, I Officer Carolyn Russo with the Florida Fish and Wildlife Conservation Commission was on water patrol on Kings Bay (Crystal River) Florida. At approximately 1700 hours I observed a vessel with three people on board in Kings Bay near Buzzard Island. I conducted a vessel inspection on the vessel and observed a white male operating THE VESSEL. The operator was later identified as Mr. Thomas Emery Thayer, with a date of birth of 09/15/1987. He was wearing swim shorts and no shirt. As I pulled alongside the vessel I advised Mr. Thayer and the occupants that we would be conducting a vessel inspection. Once we were alongside the vessel I asked Mr. Thayer to show me the required vessel equipment needed for the vessel he was operating. I asked him for life jackets for each person on the vessel and the vessel registration. He handed me an envelope with a fishing license in it and told me that he didnât think that was it. He told me he wasnât sure where the registration certificate was. I then asked Mr. Thayer to show me a throwable device, fire extinguisher, and whistle. While he was bringing me the required safety equipment I observed a strong odor of an alcoholic beverage coming from his person. I observed his eyes to be bloodshot and watery. He was sunburned. I advised him that he appeared to be impaired and asked him if he would consent TO FIELD Sobriety Tasks. He consented and I had him come on my patrol vessel in order to administer the tasks. I told Mr. Conley to sit at the bow of my patrol vessel on the starboard side. I read the general instructions to him from the Seated Battery of Standardized Field Sobriety Tasks. He confirmed that he was stable. I read Mr. Conley the Pre- Task questions and he stated âNoâ to each one except the third question. I asked, âare you sick or injured?â and he stated âasthma.â AT THAT TIME The tasks began. Task one, Horizontal Gaze Nystagmus: MR THAYER stated he was not wearing contact lenses. I read the instruction and he stated he understood. THE RESULTS WERE AS FOLLOWS: Distinct and sustained nystagmus at max deviation and onset of nystagmus prior to 45- degrees were present in both of Mr. Conleyâs eyes. Task two, Finger to Nose: The task instructions were read and demonstrated. MR THAYER STATED he understood. He did not bring his hand down after each touch of the nose and four times he did not touch with his fingertip. He used the pad. Task three, Palm Pat: The task instructions were read and demonstrated. MR THAYER stated he understood. During the task he did not increase his speed and did not count as instructed. Task four, Hand Coordination: The task instructions were read and demonstrated. He stated he understood after I repeated the first two tasks to him again. During the instruction phase he did not keep his fists to his chest and I repeated for him to stay in the position. During the performance stage he did not clap his hands and did not return his left fist to his chest. After the tasks were preformed I advised Mr. Thayer that he was under arrest for impairment. The vessel was left with the pregnant female on board who was cleared to operate the vessel. I drove Mr. Thayer and myself to the Yacht Club. At the Yacht Club I met Officer Craig Reese (FWC) and he transported Mr. Thayer to the Citrus County Jail. While MR THAYER was at the Jail the breath test operator, Ashley A Daddario, read the implied consent warning to him and he consented to the test. The test results came back with a blood alcohol content of 0.015g/210L and 0.015g/210L. He was then asked to submit to the test of his urine. He consented and the results of the test are pending. Mr. Conley was issued one warning for not having the registration certificate and one misdemeanor citation for boating while impaired. His court date was set for July 1st at 08:30a.m. at the Citrus County Courthouse. THE DEFENDANTâS BOND was set at $500.00 per the bond schedule. |
