Probable cause affidavit: |
SUBMITTED BY: CHENOWETH, JACOB 0708 (AR10117162) DID UNLAWFULLY AND KNOWINGLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA'S STATE STATUTE 893.13(6)(B). ON 100110 WHILE PATROLLING SOUTHBOUND ON US HIGHWAY 19, I OBSERVED A GREEN PICKUP TRUCK ATTEMPTED TO MAKE A U-TURN ONTO SOUTHBOUND US HIGHWAY 19. WHILE MAKING THE U-TURN, THE VEHICLE WENT ACROSS TWO LANES OF TRAFFIC, OFF THE ROADWAY WITH ALL FOUR TIRES AND ACCELERATED TO A HIGH RATE OF SPEED BACK ONTO THE ROAD. I THEN CONDUCTED A TRAFFIC STOP IN THE PARKING LOT OF DENNY'S IN CRYSTAL RIVER. UPON APPROACHING THE VEHICLE, I MADE CONTACT WITH THE SUSPECT AND INFORMED HER THAT THE REASON FOR THE STOP WAS THAT WHEN SHE MADE A U-TURN SHE LEFT THE ROAD AND ACCELERATED AT A HIGH SPEED. THE SUSPECT STATED "YES, I DID THAT BECAUSE MY FRIEND CALLED ME FROM THE BUZZ BAR STATING THAT SHE WAS JUST IN A FIGHT AND NEEDED ME TO PICK HER UP". THE SUSPECT PROVIDED ME WITH HER DRIVER'S LICENSE AND STATED THAT SHE WOULD HAVE TO GO TO THE OTHER SIDE OF HER VEHICLE TO GET HER REGISTRATION AND PROOF OF INSURANCE CARD. THE SUSPECT LEFT HER DRIVER'S SIDE DOOR OPEN AND WENT TO THE PASSENGER'S SIDE OF THE VEHICLE. THE SUSPECT ASKED IF I COULD SHINE MY FLASHLIGHT INTO THE TRUCK SO THAT SHE COULD SEE INTO THE GLOVE BOX AT WHICH TIME I NOTICED AN AROMA OF MARIJUANA EMITTING FROM THE VEHICLE. WHILE PROVIDING LIGHT FOR THE SUSPECT TO FIND THE INFORMATION, I OBSERVED A GLASS JAR CONTAINING APPROXIMATELY 7.5 GRAMS OF MARIJUANA LOCATED ON THE SEAT IN PLAIN VIEW. I ASKED THE SUSPECT WHAT WAS IN THE JAR, AT WHICH TIME SHE STATED "I FORGOT I LEFT THAT IN HERE" AND "I'M NOT GOING TO LIE, IT BELONGS TO ME". I ASKED THE SUSPECT WHY I COULD SMELL THE ODOR OF MARIJUANA IN THE VEHICLE, TO WHICH SHE STATED THAT SHE AND FRIENDS WERE SMOKING MARIJUANA IN THE PARKING LOT AT THE OAR HOUSE. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF MARIJUANA, HANDCUFFED, BEHIND HER BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WITH NO FURTHER INCIDENT. I ISSUED THE DEFENDANT WARNING NUMBER 305467B FOR FAILURE TO MAINTAIN A SINGLE LANE. THE DEFENDANT'S VEHICLE KEYS WERE TURNED OVER TO HER FRIEND PER HER REQUEST. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
