SUBMITTED BY: CIANCIA, TERRY 0575 (AR09111869) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 111109 AT APPROXIMATELY 1400 HOURS, I WAS SENT TO THE AREA OF COLEUS TERRACE AND WEST RED PINE COURT, IN REFERENCE TO A POSSIBLE INTOXICATED DRIVER IN THE AREA. UPON ARRIVAL, I MET WITH THREE MALES WHO ADVISED THAT MS TINA MARIE THOMPSON WAS OPERATING HER 1986 TOYOTA PICKUP, BLACK AND RED IN COLOR, BEARING FLORIDA TAG J500JW, WHILE INTOXICATED. AT APPROXIMATELY 1415 HOURS WHILE SPEAKING WITH THE GENTLEMAN I OBSERVED A RED AND BLACK OLDER MODEL TOYOTA PICKUP TURN ONTO COLEUS TERRACE FROM SLASH PINE AND HEAD TOWARD WEST RED PINE COURT. THE VEHICLE WAS OPERATED BY A WHITE FEMALE WHO WAS THE ONLY OCCUPANT OF THE VEHICLE AND WEARING PINK AS DESCRIBED BY THE THREE MALES. AT THE INTERSECTION OF COLEUS TERRACE AND WEST RED PINE COURT THE FEMALE LOCKED THE BREAKS ON THE PICKUP TRUCK SKIDDING APPROXIMATELY 15 FEET IN THE ROADWAY. THE FEMALE THEN PUT THE VEHICLE IN REVERSE AND SQUEALED HER TIRES TRAVERSING BACK THE WAY SHE CAME ON COLEUS TERRACE TOWARDS SLASH PINE IN REVERSE IN THE WRONG LANE OF TRAVEL. I IMMEDIATELY ENTERED MY VEHICLE TO FOLLOW THE TOYOTA PICKUP TRUCK. BY THE TIME I HAD MADE IT TO 4926 COLEUS TERRACE I OBSERVED THE VEHICLE PULLING INTO THE DRIVEWAY. I ACTIVATED MY EMERGENCY LIGHTS ON THE VEHICLE AND INITIATED A TRAFFIC STOP. I APPROACHED THE VEHICLE AND UPON APPROACHING THE VEHICLE I OBSERVED THE DRIVER TO BE MS TINA MARIE THOMPSON, DATE OF BIRTH 011670. MS THOMPSON IS WELL KNOWN BY ME AS I HAVE RESPONDED TO HER RESIDENCE FOR DOMESTIC DISPUTES NO LESS THAN 20 TIMES IN THE LAST YEAR. I ASKED MS THOMPSON TO EXIT THE VEHICLE. AT WHICH TIME, SHE REFUSED TO EXIT THE VEHICLE AND BECAME ARGUMENTATIVE. WHILE SPEAKING WITH MS THOMPSON I NOTED A STRONG ODOR OF ALCOHOL EMANATING FROM HER AS WELL AS THE VEHICLE. I ALSO OBSERVED IN PLAIN VIEW AN OPEN CONTAINER OF A NATURAL LIGHT ON THE FLOOR BOARD OF THE PASSENGER SIDE OF THE TRUCK. THERE WERE ALSO THREE UNOPENED CONTAINERS OF NATURAL LIGHT IN THE TRUCK. AT THAT POINT, I CONTINUED TO TRY AND PERSUADE MS THOMPSON TO VOLUNTARILY EXIT THE VEHICLE. MS THOMPSON WAS HAVING A VERY HARD TIME UNDERSTANDING ME AND AS I WAS HAVING A HARD TIME UNDERSTANDING HER SLURRED SPEECH. MS THOMPSON'S EYES WERE RED AND WATERY AND HER FACE WAS FLUSHED AND SHE CLEARLY EXHIBITED SIGNS OF EXCESSIVE ALCOHOL INTAKE. MS THOMPSON CONTINUED TO REFUSE TO EXIT THE VEHICLE. AT WHICH TIME, I ENTERED THE VEHICLE AND REMOVED THE SEAT BELT FROM AROUND HER. I THEN RETURNED TO THE DRIVER'S SIDE OF THE VEHICLE AND ASSISTED HER IN EXITING THE VEHICLE. MS THOMPSON FINALLY DECIDED TO VOLUNTARILY EXIT THE VEHICLE. AT WHICH TIME, SHE NEEDED THE VEHICLE TO HELP HER STAND, AS WITHOUT THE SUPPORT OF THE VEHICLE SHE SWAYED SIX INCHES BACKWARD AND FORWARD. I ASKED MS THOMPSON IF SHE WOULD SUBMITTED TO FIELD SOBRIETY TASKS, AT WHICH TIME, SHE REFUSED. AT THAT POINT, HAVING SEEN MS THOMPSON COMMITTING A VIOLATION OF FLORIDA TRAFFIC LAW WHILE OPERATING A VEHICLE AND AFTER DETERMINING THAT SHE WAS INTOXICATED, I PLACED HER UNDER ARREST FOR DUI (DRIVING UNDER THE INFLUENCE). MS THOMPSON WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE SHE HAD TO BE ASSISTED BY CORRECTIONS CORPORATIONS OF AMERICA (CCA) PERSONNEL IN EXITING THE VEHICLE AS SHE REMAINED COMBATIVE. MS THOMPSON WAS GIVEN THE OPPORTUNITY TO TAKE THE APPROVED BREATH TEST TO VERIFY THE ALCOHOL CONTENT IN HER BLOOD, TO WHICH SHE REFUSED. SHE ALSO REFUSED FIELD SOBRIETY TASKS FOR THE BREATH TECH. MS THOMPSON WAS SUBSEQUENTLY ISSUED THREE CITATIONS. CITATION NUMBER 8524FYK1, FOR DRIVING ON THE WRONG SIDE OF THE ROADWAY, IN VIOLATION OF FLORIDA STATE STATUTE 316.081, CITATION NUMBER 8525FYK2, FOR FAILURE TO CHANGE HER ADDRESS ON HER DRIVER'S LICENSE WITHIN 10 DAYS, IN VIOLATION OF FLORIDA STATE STATUE 322.19, AND FLORIDA UNIFORM TRAFFIC CITATION DUI 7077XDO1, ON WHICH THE COURT DATE OF 120309 AT 1300 HOURS WAS ASSIGNED. IT SHOULD BE NOTED THAT MS THOMPSON REFUSED TO SIGN ALL THE ISSUED CITATION, WHICH IS SO NOTED ON EACH ONE. MS THOMPSON'S VEHICLE WAS LEFT IN HER FRONT YARD WITH THE WINDOWS ROLLED UP AND SECURED, WITHOUT BEING TOWED. *NOT-EXEMPT* |
