SUBMITTED BY: HUGHES, JAMES 0500 (AR10118505) DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 122110 AT APPROXIMATELY 1921 HOURS, WHILE RUNNING STATIONARY RADAR ON WEST DUNKLIN STREET AND SOUTH HELLER AVENUE, I OBSERVED A DARK COLORED TRUCK HEADING EAST ON WEST DUNKLIN STREET. I OBSERVED THE VEHICLE TO APPEAR TO BE GOING OVER THE POSTED 35 MILE PER HOUR (MPH) SPEED LIMIT. AT THAT TIME I ACTIVATED MY FRONT RADAR AND RECEIVED A CLEAR DOPPLER TONE AND A DIGITAL READ OUT OF THE VEHICLE'S SPEED TO BE 46 MPH. AT THAT TIME THE VEHICLE HAD PASSED ME. I PULLED OUT BEHIND THE VEHICLE AND ACTIVATED MY EMERGENCY LIGHTS AND CONDUCTED A TRAFFIC STOP AT WEST DUNKLIN STREET AND SOUTH HELLER AVENUE. UPON EXITING MY VEHICLE I MADE CONTACT WITH THE DRIVER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR TODD MOORE. UPON REQUESTING the DEFENDANT'S DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, HE ADVISED THIS DEPUTY THAT HE DID NOT HAVE A VALID DRIVER'S LICENSE AND THAT IT WAS SUSPENDED FOR DRIVING UNDER THE INFLUENCE. HE ADVISED THAT HE WAS CURRENTLY ON PROBATION FOR THE SAME THING. AT THAT TIME the DEFENDANT PROVIDED THIS DEPUTY WITH HIS NAME AND SOCIAL SECURITY NUMBER and I HAD ADVISED HIM WHY I CONDUCTED THE TRAFFIC STOP, DUE TO HIS EXCESSIVE SPEED OF 46 MPH IN A 35 MPH ZONE. AT THAT TIME I RESPONDED BACK TO MY PATROL VEHICLE AND RAN THE DEFENDANT'S INFORMATION THROUGH D.A.V.I.D. AT WHICH TIME IT PROVIDED THE INFORMATION THAT ON 040210 HIS DRIVER'S LICENSE WAS SUSPENDED FOR ONE YEAR FOR DRIVING WITH AN UNLAWFUL ALCOHOL BALANCE. AT THAT TIME I RESPONDED BACK TO THE DEFENDANT'S VEHICLE, AT WHICH TIME HE ADVISED THIS DEPUTY THAT HE HAD SOMEBODY COMING TO PICK THE VEHICLE UP AND HE ASKED IF IT WAS OKAY IF IT WAS LEFT ON the SIDE OF THE ROAD. AT THAT TIME I ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR DRIVING ON A SUSPENDED DRIVER'S LICENSE. HE WAS HANDCUFFED AND PLACED IN the REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING. THE DEFENDANT'S BOND WAS SET AT $10,000.00 PER THE BOND SCHEDULE. THE DRIVER WAS ISSUED WARNING NUMBER 309991B, FOR UNLAWFUL SPEED OF 46 MPH IN A 35 MPH ZONE. HE WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 5585-GJX-4, FOR DRIVING WHILE LICENSE SUSPENDED WITH A MANDATORY COURT DATE OF 011310 AT 1300 HOURS. HE WAS ALSO ISSUED UNIFORM TRAFFIC CITATION NUMBER 5586-GJX-5, FOR DRIVER'S LICENSE NOT CARRIED UPON DEMAND, WITH A FINE OF $113.00 PAYABLE WITHIN 30 DAYS.
