SUBMITTED BY: RAMOS, ROBALDO 0515 (AR12124750) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: WAL-MART SUPER CENTER, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: THE DEFENDANT DID REMOVE MISCELLANEOUS PRODUCE, CLOTHING, TOYS AND SHOES WITH A DOLLAR AMOUNT OF $325.83, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). ON 020912 I RESPONDED TO THE WAL-MART STORE LOCATED AT 2641 EAST GULF TO LAKE HIGHWAY IN INVERNESS, IN REFERENCE TO A SHOPLIFTER BEING DETAINED. UPON ARRIVAL I MADE CONTACT WITH MR DALE WILLIAMS (LOSS PREVENTION OFFICER/WITNESS) WHO PROVIDED A SWORN WRITTEN STATEMENT. HE ADVISED HE THAT HE HAD OBSERVED THE DEFENDANT, TONI LEMMING, VIA THE IN STORE SECURITY CAMERA. HE ADVISED HE OBSERVED THE DEFENDANT SELECT 39 ITEMS FROM VARIOUS DEPARTMENTS AND CONCEAL ALL THE ITEMS IN A BAG SHE HAD PREVIOUSLY SELECTED. HE THEN OBSERVED THE DEFENDANT PASS ALL POINTS OF SALE MAKING NO EFFORT TO PAY FOR SAID ITEMS. AT THAT TIME HE IDENTIFIED HIMSELF AND DETAINED THE DEFENDANT UNTIL MY ARRIVAL. I THEN SPOKE WITH THE DEFENDANT AND READ HER MIRANDA WARNINGS BY PRE-PRINTED AGENCY CARD. AT THAT TIME THE DEFENDANT WAIVED HER RIGHTS AND AGREED TO SPEAK WITH ME. SHE ADVISED THAT SHE ENTERED THE WAL-MART STORE, SELECTED MISCELLANEOUS PRODUCE, SHOES, CLOTHES AND TOYS AND PROCEEDED TO THE EXIT THE STORE WITHOUT PAYING FOR THE ITEMS. AT THAT TIME SHE STATED SHE WAS STOPPED BY LOSS PREVENTION OFFICER WILLIAMS. ALL 39 ITEMS TOTALING $325.83 WERE RECOVERED AND RETURNED TO WAL-MART. THE DEFENDANT WAS THEN PLACED UNDER ARREST AND CHARGED WITH ONE COUNT OF GRAND THEFT. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF WHERE HER BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. THE DEFENDANT ADVISED THAT SHE HAD A PRIOR CASE FOR SHOPLIFTING IN MARION COUNTY WHICH IS CURRENTLY PENDING.
