SUBMITTED By: PHILLIPS, SHANNON 0223 (AR17-23260)(17-46334) did knowingly, actually and intentionally touch or strike DEPUTY WILLIAMS (073), a LAW ENFORCEMENT OFFICER, against the will of that person while knowing that the said OFFICER was engaged in a lawful performance of HIS legal duties, in violation of Florida Statute 784.07(2) DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR CONVEYANCE, TO WIT: THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, AND AFTER HAVING BEEN PREVIOUSLY WARNED, TO WIT: ON 040117 MALL SECURITY AS WELL AS DEPUTY WILLIAMS ASKED THE DEFENDANT TO LEAVE MULTIPLE TIMES, IS IN VIOLATION OF FLORIDA STATE STATUTES 810.08(1) AND 810.08(2)(B). ON 040117, THIS DEPUTY WAS DISPATCHED TO THE CRYSTAL RIVER MALL LOCATED AT 1801 NORTHWEST HIGHWAY 19 IN CRYSTAL RIVER IN REFERENCE TO A TRESPASSING. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY WILLIAMS (0730) WHO ADVISED THAT THE DEFENDANT, MS TONIA WALDRON, WAS ATTENDING AN EVENT BEING HELD INSIDE OF THE MALL. HE ADVISED SHE APPEARED INTOXICATED AND BEGAN TO CAUSE A DISTURBANCE. THE DEFENDANT WAS ASKED SEVERAL TIMES TO LEAVE THE PROPERTY BY MALL SECURITY, AS WELL AS BY DEPUTY WILLIAMS. HOWEVER, THE DEFENDANT REFUSED TO LEAVE. UPON MY ARRIVAL, DEPUTY WILLIAMS HAD THE DEFENDANT HANDCUFFED AND WAITING OUTSIDE OF THE BELK DEPARTMENT STORE. WHEN DEPUTY WILLIAMS ATTEMPTED TO PLACE THE DEFENDANT IN THE BACK OF MY PATROL VEHICLE, SHE ATTEMPTED TO PULL AWAY FROM HIM AND KICK HIM IN THE LEGS. AS DEPUTY WILLIAMS SAT HER DOWN ON THE BACKSEAT SHE BEGAN KICKING HIM, AGAIN. THE DEFENDANT WAS PLACED UNDER ARREST AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. the DEFENDANTâS BOND WAS SET AT $5,000.00, PER THE BOND SCHEDULE FOR BATTERY ON A LAW ENFORCEMENT OFFICER AND $1,000.00, PER THE BOND SCHEDULE FOR TRESPASS AFTER WARNING. |
