SUBMITTED BY: POLLARD, RANDALL 0677 (AR11122146) DID LOITER AND/OR PROWL IN A PLACE, AT A TIME OR IN A MANNER NOT USUAL FOR LAW ABIDING INDIVIDUALS, UNDER CIRCUMSTANCES THAT WARRANT A JUSTIFIABLE AND REASONABLE ALARM OR IMMEDIATE CONCERN FOR THE SAFETY OF PERSON(S) OR PROPERTY IN THE VICINITY, IN VIOLATION OF FLORIDA STATE STATUTE OF 856.021. ON 080911, I RESPONDED TO 410 EAST CIRCLEWOOD STREET IN INVERNESS, FLORIDA, IN REFERENCE TO A POSSIBLE BURGLARY IN PROGRESS. ACCORDING TO INFORMATION RECEIVED BY DISPATCH THERE WAS A BLACK MALE WEARING A RED SHIRT ON THE BACK SCREENED IN PORCH OF THAT RESIDENCE. DISPATCH ALSO ADVISED THAT ACCORDING TO THE COMPLAINANT, MR JAMES ROGERS, NO ONE WAS SUPPOSED TO BE AT THAT LOCATION AND THAT HE POSSIBLY KNEW who THE SUSPECT WAS. INFORMATION HE PROVIDED TO DISPATCH WAS A TREMAYNE MOBLEY. UPON ARRIVING ON SCENE, DEPUTY BERRIOS AND I OBSERVED A BLACK MALE WEARING A RED SHIRT ON THE EAST SIDE OF THE RESIDENCE WALKING THROUGH THE YARD AND HOPPING THE BACK FENCE WHICH LEADS TO US HIGHWAY 41. AT THAT TIME, DEPUTY BERRIOS AND I ADVISED THE SUBJECT TO STOP AND PLACE HIS HANDS IN THE AIR AND HE DID SO. THE DEFENDANT THEN CAME BACK ACROSS THE FENCE AND WAS DETAINED. I THEN ASKED THE SUBJECT WHAT HE WAS DOING INSIDE THE YARD OF THE RESIDENCE GIVING HIM THE opportunity TO DISPEL MY ALARM, AT WHICH TIME, HE STATED THAT HE HAD GOT DRUNK AT COACHES AND AFTER THEY CLOSED HE NEEDED SOMEWHERE TO SLEEP. HE STATED THAT HE DID NOT BREAK INTO THE RESIDENCE AND THAT ONCE HE KNEW THAT HIS NEIGHBOR HAD CALLED THE COPS HE WAS ATTEMPTING TO LEAVE. THESE EVENTS TOOK PLACE DURING DARK HOURS AT APPROXIMATELY 0445 HOURS. THE AREA WHERE THE DEFENDANT WAS FOUND WAS A HEAVILY WOODED AREA. THE DEFENDANT WAS READ HIS MIRANDA RIGHTS VIA A PREPRINTED CARD AND COULD NOT PROVIDE ME with A REASONABLE EXPLANATION FOR BEING IN THAT AREA. THE DEFENDANT STATED THAT HE USED TO LIVE AT A RESIDENCE BY THE INCIDENT LOCATION, HOWEVER, HE MOVED OUT A FEW MONTHS AGO. THE DEFENDANT ALSO STATED THAT HE DOES NOT LIVE IN THAT AREA ANYMORE AND AT THIS TIME HE IS HOMELESS. I THEN SPOKE TO A WITNESS, MR WILLIAM REDWINE, WHO ADVISED HE OBSERVED THE DEFENDANT SLEEPING ON THE BACK PORCH OF THE RESIDENCE HE ALSO STATED THAT THE DEFENDANT HAD DONE THIS IN THE PAST. MR REDWINE STATED THAT TO HIS KNOWLEDGE THE DEFENDANT DID NOT HAVE ACCESS OR PERMISSION TO BE ON THAT PROPERTY. I WAS ABLE TO FIND A CONTACT NUMBER FOR THE OWNERS OF THAT PROPERTY; HOWEVER, I COULD NOT FIND A NAME ASSOCIATED WITH IT. OUR DAYSHIFT UNITS WILL ATTEMPT TO MAKE CONTACT with the OWNERS OF THE RESIDENCE TO SEE IF THEY WISH TO PURSUE BURGLARY CHARGES. ON THE BACK PORCH TO THE RESIDENCE I DID OBSERVE A SMALL CUT IN THE SCREEN NEAR THE DOOR LATCH JUST BIG ENOUGH TO PUT A COUPLE FINGERS INSIDE AND OPEN THE LATCH. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST AND WAS TRANSPORTED TO THE COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE.
