SUBMITTED BY: SCHAFFER, HEATH 0652 (AR11118793) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A MULTI COLORED GLASS SMOKING PIPE FOUND IN THE DEFENDANT'S CONSTRUCTIVE POSSESSION, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 011211 AT 1444 HOURS, WHILE IN THE AREA OF EAST PINE LAKE LANE AND EAST SOUTH LAKE DRIVE, CONDUCTING PATROL REFERENCE TO RECENT DRUG ACTIVITY, I OBSERVED A SILVER CHEVY MALIBU BEARING THE TAG OF 501KQB, LEAVING A RESIDENCE OF INTEREST. I THEN FOLLOWED THE VEHICLE TO THE INTERSECTION OF EAST PINE LAKE LANE AND SOUTH FLORIDA AVENUE WHERE I OBSERVED THE VEHICLE FAIL TO COME TO A COMPLETE STOP BEFORE THE CLEARLY MARKED STOP BAR. I THEN ACTIVATED MY EMERGENCY LIGHTS AND THE VEHICLE THEN PULLED TO THE SIDE OF THE ROAD. I EXITED MY PATROL VEHICLE AND APPROACHED THE DRIVER, LATER IDENTIFIED AS RANDEE ROEMER, ON THE DRIVER SIDE AND ASKED FOR HER DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, WHICH SHE PROVIDED. I THEN RETURNED TO MY VEHICLE AND COMPLETED A WARNING CITATION, NUMBER 309775B, FOR HER INFRACTION. I THEN ASKED THE DRIVER TO COME BACK TO MY PATROL VEHICLE, WHERE I PROVIDED HER WITH A COPY OF THE WARNING. I THEN ASKED HER IF THERE WERE ANY GUNS, NEEDLES, KNIVES, OR ANYTHING ILLEGAL IN HER VEHICLE AND SHE STATED NO. I THEN ASKED MS ROEMER IF I COULD SEARCH HER VEHICLE, AT WHICH TIME SHE STATED YES. I THEN ASKED THE REMAINING OCCUPANTS TO EXIT THE VEHICLE, AT WHICH TIME DEPUTY MCEWEN STAYED WITH THEM AS I SEARCHED. AS I APPROACHED THE FRONT PASSENGER SIDE, I OPENED THE GLOVE BOX AND OBSERVED AN OPEN CHEETOS BAG AND AS I OPENED IT, I SAW A MULTI COLORED GLASS SMOKING PIPE INSIDE. THE DEFENDANT, BEING THE FRONT SEAT PASSENGER, WAS THEN PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE BACK SEAT OF MY PATROL VEHICLE. THE OTHER OCCUPANTS INFORMATION WAS GATHERED AND THEY WERE ADVISED THEY WERE FREE TO GO. WHILE IN ROUTE TO THE CITRUS COUNTY DETENTION FACILITY I READ THE DEFENDANT MIRANDA VIA PRE-PRINTED CARD. HE ADVISED THAT HE DID WISH TO SPEAK WITH ME. HE ADVISED, WHEN ASKED WHO'S SMOKING PIPE IT WAS, THAT YES IT WAS HIS AND THAT HE DID USE IT TO SMOKE MARIJUANA. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS PROCESSED, BOOKED AND GIVEN THE BOND OF $500.00 "If you are a person with a disability who needs any accommodation in order to participate in this proceeding, you are entitled, at no cost to you, to the provision of certain assistance.
