SUBMITTED BY: FARNHAM, TODD 0368 (AR09108134) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: TWO PERCOCET PILLS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A) AND DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF TWENTY GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B) AND DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: CANNABIS COMMONLY REFERRED TO AS MARIJUANA, SAID OBJECT BEING TOLLING PAPERS, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1) AND did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2) ON 031409 AT APPROXIMATELY 0140 HOURS, I INITIATED A TRAFFIC STOP AT EAST BAYBERRY LANE AND SOUTH SPOONBILL AVENUE IN FLORAL CITY ON A BLACK CHEVROLET FOUR DOOR VEHICLE BEARING FLORIDA TAG E60-7XG FOR EXPIRED TAG MORE THAN SIX MONTHS. I MADE CONTACT WITH THE DRIVER/DEFENDANT, MR TRIFTON C HUFF, WHO STATED THAT HE DID KNOWN HIS TAG WAS EXPIRED AND ALSO KNEW HIS DRIVER LICENSE WAS SUSPENDED. HE STATED HE HAD ONLY COME INTO THIS NEIGHBORHOOD TO FIND HIS LOST RING. I CHECKED THE DEFENDANT'S DRIVER LICENSE STATUS VIA TELETYPE AND WAS INFORMED THAT THE DEFENDANT'S DRIVER LICENSE WAS SUSPENDED FOR TWO YEARS. THE DEFENDANT WAS ARRESTED FOR DRIVING WHILE LICENSE SUSPENDED (DWLS,) KNOWINGLY. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK. CANINE DEPUTY ANSTEAD ARRIVED ON SCENE AND WALKED CANINE DOZER AROUND THE VEHICLE. CANINE DOZER DID NOT ALERT TO THE VEHICLE. THE DEFENDANT WAS SEARCHED INCIDENT TO ARREST. THE DEFENDANT ADVISED MARIJUANA WOULD BE FOUND UNDER THE DRIVER SIDE ARMREST. CANINE DEPUTY ANSTEAD LOCATED THE MARIJUANA IN THIS AREA. SHE ALSO LOCATED TWO WHITE PILLS AND ONE PACK OF ZIGZAG ROLLING PAPERS. WHEN ASKED WHAT THE TWO WHITE PILLS WERE, THE DEFENDANT STATED HE HAD PURCHASED PERCOCET PAIN PILLS ILLEGALLY BUT HE WOULD NOT ADVISE WHERE OR FROM WHOM HE HAD PURCHASED THE PILLS. AT THAT TIME, I CONTACTED THE DEFENDANT'S PARENTS WHO ARRIVED ON SCENE TO TAKE CUSTODY OF THE DEFENDANT'S VEHICLE. THE DEFENDANT WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $3,500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 248003B, FOR EXPIRED TAG. HE WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER 9227-FEW, FOR DWLS, KNOWINGLY. THE DEFENDANT REFUSED TO SIGN HIS CITATION. *NOT-EXEMPT* |
