SUBMITTED BY: REYNOLDS, CONNARY 1267 (AR13-6987) DID UNLAWFULLY FIGHT WITH ONE OR MORE PERSONS, TO WIT: ENGAGED IN A BRAWL, WHICH RESULTED IN PHYSICAL INJURIES, IN A PUBLIC PLACE, TO WIT: THE CHEVRON PARKING LOT, LOCATED AT 639 NE HIGHWAY 19, CRYSTAL RIVER, TO THE TERROR OF THE PEOPLE IN VIOLATION OF FLORIDA STATE STATUTE 870.01(1). ON 082213 AT APPROXIMATELY 2145 HOURS, WHILE ON A CITIZENS ASSIST ACROSS THE STREET FROM THE CHEVRON GAS STATION LOCATED A 639 NE HIGHWAY 19, CRYSTAL RIVER, I WAS ADVISED BY CITIZENS THAT THERE WERE PEOPLE ACTIVELY ENGAGING IN A BRAWL ACROSS THE STREET. I TURNED AROUND AND OBSERVED SEVERAL PEOPLE FIGHTING, WRESTLING AND PUNCHING, AT WHICH TIME, I UPDATED DISPATCH THAT I WOULD BE ON A PHYSICAL DISTURBANCE AT THE CHEVRON AND REQUESTED BACKUP. UPON MY ARRIVAL THE PARTIES HAD SEPARATED, WHERE TWO SUBJECTS WERE LOCATED INSIDE THE CHEVRON AND TWO WERE OUTSIDE OF THE CHEVRON, THERE WAS ALSO A WITNESS ON THE OTHER SIDE OF THE BUILDING. WHILE APPROACHING, I OBSERVED A WHITE FEMALE LATER IDENTIFIED AS DEFENDANT ONE, MS JESSICA MACCLUGAGE, WALKING TOWARDS ME HOLDING HER HEAD SCREAMING âHE BUSTED MY HEADâ. I THEN ADVISED DISPATCH TO HAVE EMERGENCY MEDICAL SERVICES RESPOND TO THE SCENE. I ASKED DEFENDANT ONE WHY EVERYONE WAS FIGHTING AND SHE ADVISED THAT HER AND HER FRIENDS PULLED UP TO THE CHEVRON AND WERE APPROACHED BY HER EX-BOYFRIENDâS NEW GIRLFRIEND/DEFENDANT FOUR, MS JENNIE DICK. DEFENDANT ONE WAS PUNCHED SEVERAL TIMES WITH A CLOSED FIST THROUGH THE WINDOW BY DEFENDANT FOUR. AT THAT TIME, DEFENDANT ONE GOT OUT OF THE VEHICLE AND BEGAN FIGHTING WITH DEFENDANT FOUR. DEFENDANT ONE ADVISED THAT THEY STOPPED FOR A WHILE, AT WHICH TIME, SHE WENT INSIDE THE CHEVRON, WHERE DEFENDANT FOUR TOLD HER TO GET OUT AND THEY ENGAGED IN ANOTHER FIGHT INSIDE THE CHEVRON. SHE STATED that DEFENDANT TWO, MR ANTHONY SCHUBERT, ALONG WITH DEFENDANT THREE, MR TROY TAFLINGER, JUMPED INTO THE FIGHT AND TRIED TO BREAK IT UP,. DEFENDANT ONE WAS PICKED UP BY DEFENDANT TWO AND HE TOOK HER OUTSIDE AND THREW HER AGAINST THE CONCRETE, WHICH âBUSTEDâ HER HEAD OPEN AND CAUSED OTHER INJURIES. DEFENDANT ONE STATED THAT SHE WAS IN FEAR FOR HER LIFE. I DID OBSERVE A SMALL LACERATION ON THE TOP OF DEFENDANT ONEâS HEAD. THIS INJURY WAS LATER PHOTOGRAPHED AT THE CITRUS COUNTY DETENTION FACILITY. DEFENDANT ONE WAS CHECKED OUT BY EMERGENCY MEDICAL SERVICES AND SHE DECLINED TREATMENT. I MADE CONTACT WITH DEFENDANT TWO, MR ANTHONY SCHUBERT. I OBSERVED THAT HE ALSO HAD A LACERATION ON THE TOP OF HIS HEAD AND HE WAS CHECKED OUT BY EMERGENCY MEDICAL SERVICES AND DECLINED TREATMENT. DEFENDANT TWO ADVISED THAT HIS EX-GIRLFRIEND/DEFENDANT ONE AND HIS NEW GIRLFRIEND/DEFENDANT FOUR, HAVE BEEN FIGHTING ON FACEBOOK AND IN TEXT MESSAGES FOR THE LAST FEW WEEKS. HE ADVISED WHEN DEFENDANT ONE ARRIVED AT THE GAS STATION, DEFENDANT FOUR CONFRONTED HER, AT WHICH TIME, A BRAWL BROKE OUT. HE STATED PEOPLE WERE HITTING DEFENDANT FOUR (HIS GIRLFRIEND)AND HE TRIED TO BREAK THE FIGHT UP AND WHILE TRYING TO BREAK THE FIGHT UP DEFENDANT ONE FELL AND HIT HER HEAD, WHICH IS WHAT CAUSED THE LACERATION ON HER HEAD. DEFENDANT TWO STATED HE ALSO THREW A PUNCH AT DEFENDANT THREE AND WAS ALSO PUNCHED BY DEFENDANT THREE. DEFENDANT TWOâS INJURIES WERE LATER PHOTOGRAPHED AT THE CITRUS COUNTY DETENTION FACILITY. I SPOKE WITH DEFENDANT THREE, MR TROY TAFLINGER, WHO ADVISED THAT DEFENDANT FOUR WALKED UP TO THEIR VEHICLE THAT THEY WERE SITTING IN AND STRUCK HIS GIRLFRIEND/DEFENDANT ONE THROUGH THE WINDOW SEVERAL TIMES. THEY BEGAN FIGHTING WHERE DEFENDANT THREE THEN TRIED TO STOP THE FIGHT AND WAS HIT BY DEFENDANT FOUR AND DEFENDANT TWO, HE ALSO OBSERVED HIS GIRLFRIEND/DEFENDANT ONE BEING HIT ON HER HEAD. I OBSERVED NO PHYSICAL INJURIES ON DEFENDANT THREE. IT SHOULD BE NOTED THAT I THIS DEPUTY DID OBSERVE DEFENDANT THREE INVOLVED IN the BRAWL AT THE TIME OF MY ARRIVAL. I THEN SPOKE WITH DEFENDANT FOUR, MS JENNIE DICK, WHO HAD A SMALL CHILD IN HER HANDS. SHE STATED THAT SHE AND DEFENDANT ONE HAD BEEN FIGHTING OVER FACEBOOK AND TEXT MESSAGES OVER THE PAST FEW WEEKS, ABOUT HER EX-BOYFRIEND/DEFENDANT TWO. DEFENDANT FOUR STATED THAT SHE WOULD BE âSTRAIGHT UPâ WITH ME AND STATED THAT WHEN DEFENDANT ONE ARRIVED IN THE VEHICLE WITH DEFENDANT THREE, SHE APPROACHED THE VEHICLE AND STRUCK DEFENDANT ONE, AT WHICH TIME, THE BRAWL WAS INITIATED. I OBSERVED NO VISIBLE INJURIES ON DEFENDANT FOUR. CONTACT WAS MADE WITH THE WITNESS, MR DAVID KINNEY, WHO ADVISED THAT HE WAS IN THE VEHICLE WITH DEFENDANT ONE AND DEFENDANT THREE, AT WHICH TIME, DEFENDANT FOUR WALKED UP TO THE VEHICLE AND STARTED HITTING DEFENDANT ONE IN THE FACE REPEATEDLY AND WOULD NOT STOP HITTING HER. AT THAT TIME, DEFENDANT TWO TRIED TO INTERVENE AND HIT DEFENDANT ONE IN THE FACE ALSO. I SPOKE WITH THE CLERK AT THE CHEVRON IN REFERENCE TO OBTAINING POSSIBLE EVIDENCE AND WAS ADVISED THAT THEIR CAMERAS HAVE NOT BEEN WORKING FOR SEVERAL MONTHS AND HE HAD NOT SEEN THE BRAWL. IT SHOULD BE NOTED THAT WHILE SPEAKING WITH EACH OF THE DEFENDANTS, DEFENDANT ONE AND TWO, KEPT GETTING IN VERBAL ARGUMENTS AND HAD TO BE SEPARATED SEVERAL TIMES. AT THIS TIME, DEFENDANT ONE WAS PLACED UNDER ARREST FOR AFFRAY, HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED), WHERE SHE WAS SEARCHED AND SECURED BY DEPUTY ALEXANDER, PLACED IN THE REAR OF HER PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (AR13-6985). DEFENDANT THREE, WAS PLACED UNDER ARREST FOR AFFRAY, HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED), WHERE HE WAS SEARCHED AND SECURED BY DEPUTY T TAYLOR (0700), PLACED IN THE REAR OF HIS PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. (AR13-6987) DEFENDANT FOUR WAS ISSUED NOTICE TO APPEAR NUMBER 20628, FOR AFFRAY, WITH A MANDATORY COURT APPEARANCE OF 091213 AT 1300 HOURS, AT THE CITRUS COUNTY COURTHOUSE. DEFENDANT FOUR WAS ISSUED NOTICE TO APPEAR DUE TO HER HAVING A SMALL CHILD WITH HER (AR13-6988). DEFENDANT TWO WAS PLACED UNDER ARREST FOR AFFRAY, HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED), WHERE I SEARCHED HIM AND LOCATED A BAG OF SYNTHETIC DRUGS AND WAS ADVISED BY HIM THAT HE DOES USE IT, BUT HAS NOT TONIGHT. HE STATED HE HAD IT IN HIS POSSESSION FOR A friend. HE WAS THEN SECURED in the REAR OF MY PATROL VEHICLE AND HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (AR13-6986). ALL DEFENDANTS THAT WERE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WERE CHARGED WITH AFFRAY WITH A $500.00 BOND (EACH DEFENDANT ), PER THE BOND SCHEDULE. IT WAS LATER DETERMINED THAT THE VEHICLE ON SCENE BELONGED TO DEFENDANT THREE, WHICH WAS SECURED AND LEFT ON SCENE. DEFENDANT ONE, DEFENDANT TWO, DEFENDANT THREE AND THE WITNESS COMPLETED SWORN WRITTEN STATEMENTS, WHICH WERE LATER TURNED OVER TO CITRUS COUNTY SHERIFF'S OFFICE RECORDS. DEFENDANT FOUR ADVISED SHE DID NOT WANT TO COMPLETE A WRITTEN STATEMENT. THE DEPARTMENT OF CHILDREN AND FAMILIES WAS CONTACTED, WHERE I SPOKE TO MARRISSA NUMBER 053, WHO ADVISED THAT A REPORT WOULD BE GENERATED FOR THIS INCIDENT. |
