SUBMITTED BY: CIANCIA, TERRY 0575 (AR09109133) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE FINISH LINE SHOE STORE, TO WIT: A BLUE NEW ERA YANKEES HAT, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(A). AT 1431 HOURS ON 051809, I WAS DISPATCHED TO THE FINISH LINE SHOE STORE IN THE CRYSTAL RIVER MALL. UPON ARRIVAL, I OBSERVED TWO MALL SECURITY OFFICERS SPEAKING WITH A BLACK MALE, LATER IDENTIFIED AS THE DEFENDANT, MR UZEL TYRELL. I THEN SPOKE WITH THE STORE MANAGER, WHO ADVISED THAT AT APPROXIMATELY 1420 HOURS ON THIS DATE, THE BLACK MALE ENTERED the STORE WITH TWO OTHER SUBJECTS, A WHITE MALE AND A WHITE FEMALE. SHE ADVISED THAT THE WHITE MALE AND WHITE FEMALE MADE SMALL TALK WITH HER AND ANOTHER EMPLOYEE WHILE THE BLACK MALE HEADED DIRECTLY TOWARD THE HATS. SHE OBSERVED THE BLACK MALE REMOVE the BLACK HAT HE WAS WEARING UPON ENTERING THE STORE AND PLACE A ROYAL BLUE NEW ERA NEW YORK YANKEES HAT INSIDE HIS HAT. HE CONTINUALLY TRIED TO CONCEAL IT AS HE WALKED AROUND the STORE. AFTER APPROXIMATELY TWO MINUTES OF WALKING AROUND the STORE CONCEALING THE BLUE HAT, THE SUSPECT THEN EXITED THE STORE WITHOUT PAYING FOR THE HAT. THE SUSPECT WAS DETAINED BY MALL SECURITY UNTIL MY ARRIVAL. UPON MY ARRIVAL, THE SUSPECT WAS PLACED UNDER ARREST FOR RETAIL THEFT, HANDCUFFED, DOUBLE LOCKED, AND PLACED IN the REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
