SUBMITTED BY: COX, ANDY 0543 (AR10114753) THE DEFENDANT DID HAVE AN UNASSIGNED TAG ATTACHED IN VIOLATION OF FLORIDA STATE STATUTE, 320.261 THE DEFENDANT DID DRIVE AN UNREGISTERED MOTOR VEHICLE ON THE HIGHWAYS OF FLORIDA IN VIOLATION OF FLORIDA STATE STATUTE, 320.02(1). ON 051010, AT APPROXIMATELY 1920 HOURS, I OBSERVED A BLUE DODGE QUAD CAB PICKUP TRUCK PULLING INTO THE PARKING LOT OF WINN DIXIE IN HOMOSASSA SPRINGS. I WAS FAMILIAR WITH THE VEHICLE, AND GOT UP and WALKED TO THE FRONT OF SUBWAY SANDWICH SHOP. FROM MY VANTAGE POINT I WAS ABLE TO SEE THROUGH THE VEHICLE'S FRONT WINDSHIELD. I OBSERVED THE WINDSHIELD TO HAVE TWO LARGE SPIDER CRACKS WHICH IS CONSISTENT WITH TWO HEADS HITTING THE WINDSHIELD ON BOTH THE DRIVER'S AND THE PASSENGERS SIDE. AT THAT TIME, I OBSERVED A MALE DRIVER with A WHITE TANK TOP SHIRT AND A FEMALE PASSENGER WITH BLONDE HAIR. THEY OPENED THE DOORS TO THE VEHICLE WHERE I OBSERVED THE DEFENDANT, MR MICHAEL PAQUET, SITTING BEHIND THE WHEEL. I OBSERVED THE FEMALE DEFENDANT, MS VICKIE KLEIN TO BE SITTING ON THE PASSENGER SIDE OF THE VEHICLE. I BELIEVED THE OPERATOR OF THE VEHICLE TO BE DEFENDANT MICHAEL PAQUET, WHO WAS WEARING GREEN SHORTS AND A WHITE TANK TOP. I THEN LEFT SUBWAY AND WENT TO MY PATROL VEHICLE WHERE I RAN A "DAVID" QUERY ON DEFENDANT MICHAEL PAQUET TO MAKE SURE HE WAS STILL DRIVING WITH LICENSE SUSPENDED OR REVOKED, AND WAITED IN THE PARKING LOT. DEFENDANT'S PAQUET AND KLEIN BOTH RETURNED TO THE VEHICLE APPROXIMATELY 15 MINUTES LATER. UPON ENTERING THE VEHICLE THE FEMALE DEFENDANT GOT IN ON THE DRIVER'S SIDE, and THE MALE DEFENDANT GOT IN THE PASSENGER SIDE. I OBSERVED A SMALL DOG JUMPING AROUND THE PICKUP TRUCK. I OBSERVED THE PICKUP TRUCK TO HAVE A BROKEN FRONT WINDSHIELD, EXTREMELY DARK TINT AND A TAG ATTACHED THAT DID NOT COME BACK TO THE PICKUP TRUCK. AT THAT TIME I INITIATED A TRAFFIC STOP ON THE WAL- MART SIDE OF THE PARKING LOT APPROACHING US HIGHWAY 19. I THEN APPROACHED the PASSENGER SIDE WHERE I ASKED THE PASSENGER FOR HIS DRIVER'S LICENSE, TO WHICH HE RESPONDED, "I don't HAVE ONE, IT'S REVOKED." I TOLD HIM TO STEP OUT OF THE VEHICLE AT WHICH TIME HE BEGAN TO ARGUE WITH ME. AT THAT TIME I DETECTED AN ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH. I THEN PUT HIS RIGHT ARM BEHIND HIM IN A WRIST LOCK WHERE I THEN HANDCUFFED HIM (DOUBLE LOCKED) BEHIND HIS BACK. I THEN ASKED THE DEFENDANT HIS NAME TO WHICH HE ADVISED ME. AT THAT TIME, I PLACED THE DEFENDANT IN THE REAR OF MY PATROL VEHICLE AND REQUESTED THAT ANOTHER UNIT BE EN ROUTE TO SCENE. AT THAT TIME I APPROACHED THE FEMALE DRIVER/DEFENDANT/VICKIE KLEIN AND ASKED HER FOR HER DRIVER'S LICENSE, WHICH SHE THEN PRODUCED. I HAD ALREADY RUN A "DAVID" QUERY ON HER AND HAD BEEN ADVISED THAT HER LICENSE WAS VALID. I THEN ASKED DEFENDANT KLEIN FOR THE VEHICLE REGISTRATION AND PROOF OF INSURANCE, WHICH SHE ADVISED THIS DEPUTY THAT SHE DID NOT HAVE. I THEN USED MY CALIBRATED TINT METER TO CHECK THE TINT ON THE VEHICLE, WHICH RESULTED IN THE TINT BEING FOUR PERCENT. AT THAT TIME, DEPUTY HOLTZHOUSE ARRIVED ON SCENE TO ASSIST ME. I THEN RAN A RECORDS CHECK ON THE VIN NUMBER OF THE VEHICLE WHICH CAME BACK TO A DIFFERENT PERSON. UPON QUESTIONING DEFENDANT KLEIN ON THIS, SHE ADVISED THAT THE TAG WAS FROM HER OTHER VEHICLE. I ASKED HER IF SHE HAD PUT that TAG ON THE VEHICLE IN QUESTION TO WHICH SHE ADVISED, YES. I ASKED HER IF SHE HAD GONE TO THE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES TO MAKE THE CHANGE TO WHICH SHE RESPONDED, NO. I ASKED HER IF THERE WAS INSURANCE ON THE VEHICLE, TO WHICH SHE RESPONDED, NO. I THEN PLACED DEFENDANT KLEIN UNDER ARREST WHERE SHE WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND SEATED IN THE REAR OF MY PATROL VEHICLE. DEPUTY HOLTZHOUSE THEN ISSUED THE FEMALE DEFENDANT A UNIFORM TRAFFIC CITATION FOR NO PROOF OF INSURANCE AND COMPLETED A TOW FORM. AT THAT TIME, I SEARCHED THE VEHICLE AND UNDER THE PASSENGER SEAT FOUND A HALF FULL BUSCH BEER CAN WITH THE ODOR OF AN ALCOHOLIC BEVERAGE WHICH WAS STILL COLD. ON THE DRIVER'S SIDE WHERE THE FEMALE DEFENDANT HAD GOTTEN UP I DISCOVERED A CUT STRAW APPROXIMATELY THREE INCHES LONG ABOUT HALFWAY UNDER THE SEAT. WHEN I ASKED THE DEFENDANT ABOUT THE STRAW, SHE ADVISED THAT SHE USED IT TO TAKE HER PRESCRIPTION MEDICATION. THERE WAS A SMALL AMOUNT OF POWDER RESIDUE ON THE STRAW. AT THAT TIME, THE DOG JUMPED OUT OF THE VEHICLE AND WAS RUNNING AROUND. I THEN OPENED UP THE REAR OF MY PATROL VEHICLE AND LET THE DOG STAY WITH DEFENDANTS. AT THAT TIME I CONTACTED ANIMAL CONTROL TO ADVISE THAT THE DOG WAS NOT UPDATED ON ITS RABIES SHOTS AND DID NOT HAVE A COUNTY LICENSE. A SHORT TIME LATER ANIMAL CONTROL RESPONDED AND TOOK CUSTODY OF THE DOG. I THEN CLEARED THE SCENE. DEFENDANT MICHAEL PAQUET WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS CHARGED WITH ONE COUNT OF DRIVING WHILE LICENSE WAS SUSPENDED OR REVOKED KNOWINGLY WITH HIS BOND SET AT $2,000.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION 1335 ESH (X) FOR HABITUALLY DRIVING WHILE LICENSE IS SUSPENDED OR REVOKED KNOWINGLY WITH PRIOR FELONIES. HE WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION1336 ESH (1) FOR PASSENGER HAVING AN OPEN CONTAINER. DEFENDANT KLEIN WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND CHARGED WITH ONE COUNT OF ATTACHED VEHICLE UNASSIGNED AND ONE COUNT OF NO MOTOR VEHICLE REGISTRATION WITH A TOTAL BOND OF $500.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION 1331 ESH (7) FOR TINT TOO DARK, UNIFORM TRAFFIC CITATION 1332 ESH (8) FOR CRACKED WINDSHIELD, AND UNIFORM TRAFFIC CITATION 6751 FRY (2) FOR NO PROOF OF INSURANCE.
