SUBMITTED BY: RAMOS, ROBALDO 0515 (AR09107728) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 25 10 MG HYDROCODONE PILLS IN A CLEAR PLASTIC BAGGIE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: THE DEFENDANT PUSHED AND SLAPPED THE VICTIM, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 021809 I WAS DISPATCHED TO ROC'S 491 BAR AND GRILL, AT 3891 NORTH LECANTO HIGHWAY IN REFERENCE TO A DISTURBANCE IN PROGRESS. AS I WAS EN ROUTE DISPATCH ADVISED THE FEMALE CUSTOMER WAS NOW BEING COMBATIVE AND PHYSICAL. UPON ARRIVAL I OBSERVED THE VICTIM HOLDING THE DEFENDANT IN A BEAR HUG AGAINST THE DEFENDANT'S VEHICLE. AT THAT TIME, AS I APPROACHED THE DEFENDANT AND VICTIM, THE VICTIM RELEASED THE DEFENDANT. I SPOKE WITH THE DEFENDANT AND ASKED WHAT WAS GOING ON. SHE STATED SHE DID NOT KNOW, AND HAD JUST GOTTEN ATTACKED. THE DEFENDANT DID NOT HAVE ANY SIGN OF INJURY BUT WAS VERY INTOXICATED TO THE POINT SHE WAS UNABLE TO STAND WITHOUT HOLDING ON TO SOMETHING FOR BALANCE. THE DEFENDANT ATTEMPTED TO USE ME AS LEVERAGE SEVERAL TIMES AS I WAS INTERVIEWING HER. I ASKED THE DEFENDANT, IDENTIFIED AS MS VICKIE FIELDS, IF SHE HAD BEEN ATTACKED FOR NO REASON, AND SHE SAID YES. I THEN MADE CONTACT WITH THE VICTIM, WHO PROVIDED A WRITTEN STATEMENT AND ADVISED WHILE HE WAS INSIDE ROC'S 491 BAR, HE OBSERVED A MALE AND FEMALE PLAYING POOL, AND AS HE CONTINUED CHECKING THE PLACE OF BUSINESS, HE NOTICED THE MALE AND FEMALE HAD DISAPPEARED. HE THOUGHT THAT BOTH OF THEM MAY HAVE GONE INTO THE RESTROOMS. AFTER WAITING TEN MINUTES THE VICTIM ENTERED THE MEN'S ROOM AND LOOKED UNDERNEATH THE STALL AND NOTICED TWO SETS OF FEET. THE VICTIM THEN BANGED ON THE DOOR AND ADVISED THEM TO GET OUT OF THE STALL AND LEAVE THE PREMISES. AS THE DEFENDANT STARTED TO WALK TOWARD THE EXIT, SHE BEGAN ARGUING WITH THE VICTIM. AS SHE WAS LEAVING, SHE ATTEMPTED TO SWING AT THE VICTIM, AT WHICH TIME HE GRABBED HER AND TOLD HER TO STOP AND LEAVE THE PREMISES, AT WHICH TIME SHE EXITED THE BUSINESS. AS THE UNKNOWN MALE WAS ATTEMPTING TO LEAVE THE BUSINESS, THE DEFENDANT WALKED IN FRONT OF THE UNKNOWN MALE'S VEHICLE, NOT LETTING THE MALE SUBJECT LEAVE. THE PASSENGER OF THE VEHICLE THEN ASKED THE VICTIM IF HE COULD PLEASE HAVE THE DEFENDANT REMOVED SO HE COULD LEAVE. THE VICTIM ASKED THE DEFENDANT TO GET AWAY FROM THE FRONT OF THE UNKNOWN MALE'S VEHICLE, AT WHICH TIME SHE PUSHED THE VICTIM AND PUNCHED THE VICTIM IN THE FACE. THE VICTIM THEN GRABBED THE DEFENDANT IN A BEAR HUG TO CALM HER DOWN. THE DEFENDANT ADVISED THE VICTIM TO PLEASE LET HER GO AND THAT SHE WAS GOING TO CALM DOWN. ONCE THE VICTIM LET GO OF THE DEFENDANT, THE DEFENDANT AGAIN STARTED TO PUSH THE VICTIM AND AGAIN ATTEMPTED TO SLAP HIM. HE AGAIN RESTRAINED HER BY PLACING HER IN A BEAR HUG. THE DEFENDANT TOLD THE VICTIM SHE WAS GOING TO CALM DOWN FOR REAL, AT WHICH TIME SHE BECAME COMBATIVE TOWARD A WITNESS (PETER), AND PUSHED HIM AND WITNESS TWO (PATTY). AT THAT TIME THE VICTIM RESTRAINED THE DEFENDANT FOR THE THIRD TIME, AT WHICH TIME I ARRIVED. I SPOKE WITH WITNESS ONE AND TWO WHO CORROBORATED THE VICTIM'S STORY. WITNESS ONE AND TWO DID SIGN A WAIVER OF PROSECUTION REGARDING BATTERY. THE DEFENDANT WAS ARRESTED, HANDCUFFED DOUBLE LOCKED, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL A SEARCH OF HER PURSE WAS CONDUCTED, AT WHICH TIME A CLEAR BAGGIE CONTAINING 25 10 MILLIGRAM HYDROCODONE PILLS WERE LOCATED IN HER PURSE ON THE SIDE ZIPPER POUCH. WAIVERS AND STATEMENTS WERE TURNED OVER TO RECORDS. THE DEFENDANT'S BOND WAS SET AT $5500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
