SUBMITTED BY: BYRD, JEDIDIAH 0737 (AR14-12046) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF A MERCHANT/VICTIM, PUBLIX, TO WIT: TWO FOOT LONG SUBS AND A BOX OF SUSHI, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $100.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 091914, I WAS DISPATCHED TO PUBLIX GROCERY STORE AT 1012 WEST MAIN STREET IN INVERNESS, IN REFERENCE TO A RETAIL THEFT THAT HAD already OCCURRED. TWO FEMALE SUSPECTS WERE BEING DETAINED PENDING MY ARRIVAL. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, MR JOSEPH CANOVA. THE COMPLAINANT STated THAT TODAY HE OBSERVED TWO WHITE FEMALES, LATER IDENTIFIED AS the suspects MS KASSONDRA BIRSTLER AND MS VICTORIA LEMONS, ENTER the STORE AT APPROXIMATELY 1448 HOURS. HE ADVISED THAT THEY WERE SHOPPING THROUGHOUT THE STORE. THE FEMALES WENT TO THE DELI WHERE THEY ORDERED TWO FOOT LONG SUBS AND ALSO SELECTED ONE BOX OF SUSHI FROM the FREEZER AREA. HE STATED HE OBSERVED THE FEMALES WALK THROUGH THE STORE. HE ADVISED ONE OF THE FEMALES, MS KASSONDRA BIRSTLER, HAD A LARGE PURSE SITTING ON TOP OF THE SUBS and SUSHI IN THE CART. HE ADVISED THEY WENT DOWN ISLE 13 AND BOTH SUBJECTS CONCEALED THE SUBS AND SUSHI INSIDE KASSONDRA'S PURSE. THE COMPLAINANT STATED KASSONDRA'S GRANDMOTHER WAS WAITING FOR HER AT CHECKOUT REGISTER NUMBER 8. THE SUSPECTS PROCEEDED TO the REGISTER TO CHECKOUT WHERE THE COMPLAINANT ADVISED THEY DID NOT PAY FOR THE SUBS AND SUSHI that WAS IN KASSONDRA'S PURSE. THE COMPLAINANT STATED AFTER THEY PASSED ALL POINTS OF SALE HE APPROACHED THEM AND ASKED THEM ABOUT THE ITEMS WHICH WERE IN KASSONDRA'S PURSE. SHE ADVISED SHE DID NOT TAKE THEM. HE ASKED THEM ONCE AGAIN AND THEN SHE ADMITTED TO TAKING THE ITEMS and THEN OFFERED TO PAY FOR THE items. AT THAT TIME, THE COMPLAINANT ESCORTED BOTH SUSPECTS TO THE manager's OFFICE AND REcovered the STORE's MERchandise. law enforcement was then called to respond. i MADE CONTACT WITH the DEFENDANTs and READ THEM THeir MIRanda rights VIA PRePRinted CARD. both DEFENDANTs advised they understood their rights and agreed to speak to me. I aSKED THE DEFENDANTs WHY THEY HAD Taken THE ItEMS. THEY ADVised BECAuse THEir FOOD STAMP CARD would NOt PAY FOR THOSE KINDS OF ITEMS. THEY ADMITTED TO TAKING the merchandise. THEY DID HAVE A FULL CART OF GROCeries, WHICH PUbLIx CREDITED BACK TO THEIR FOOD STAMP CARD. THE STORe's merchandise WAS TURNed back TO the PUbLIx STORe, which consisted of TWO FOOT LONG SUBS AND A box of SUSHI worth $25.51. SWorn, WRitten STatements WERE FILLED OUT by THE COMPLAINANT AND TURNed INtO RECORDS. a COPy OF the receipt WILL BE TUrNED INtO RECOrds, ALONg WITh A Property RECEIPT AND a "DVD" OF THE INCIDENT. both DEFENDANTs will be trespassed from publix. both defendants were placed under arrest for retail petit theft. they were placed in handcuffs (double locked) behind the back and secured in the rear seat of my patrol vehicle. the DEFENDANTs were transported to the citrus county detention facility for booking and processing. the DEFENDANTs bond was set at $500.00, PER THE BOND SCHEDULE. |
