SUBMITTED BY: GERENA, GABRIEL 1361 (AR15-17675) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: WALMART OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: THE DEFENDANT TOOK 13 MISCELLANEOUS ITEMS FROM WALMART WITH A TOTAL VALUE OF $572.25 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 121815, I WAS DISPATCHED TO WALMART SUPERCENTER LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY IN INVERNESS IN REFERENCE TO A SEPARATE CALL FOR RETAIL THEFT. WHILE AT WALMART TALKING TO WALMART LOSS PREVENTION EMPLOYEE INVESTIGATING A DIFFERENT RETAIL THEFT CALL, THE WALMART LOSS PREVENTION EMPLOYEE AND I WATCHED TWO FEMALE SUBJECTS WALK OUT OF THE WALMART WITH A SHOPPING CART FULL OF UNPAID MERCHANDISE OUT INTO THE PARKING LOT. WHEN I ARRIVED ON SCENE IN REFERENCE TO THE UNRELATED RETAIL THEFT CALL, WITNESS, MR JOSEPH COMPOSTELLA, WHO IS A WALMART LOSS PREVENTION EMPLOYEE, AND I WERE WALKING THROUGH THE GARDEN CENTER AND ENTERED THE STORE WHEN WE OBSERVED TWO FEMALE SUBJECTS WITH A SHOPPING CART FULL OF MERCHANDISE WALK PAST THE CASHIERS INSIDE THE STORE AND WALK OUT OF THE AUTOMATIC DOORS OUTSIDE INTO THE GARDEN CENTER. THE WITNESS AND I BOTH WATCHED THE TWO SUSPECTS WALK OUT OF THE GARDEN CENTER INTO THE PARKING LOT TO THEIR PARKED VEHICLE. ONCE I SAW THIS OCCUR, I WALKED UP TO THE FEMALE SUSPECTS AND CONFRONTED THEM AS THEY HAD THE VEHICLE OPEN AND WERE ABOUT TO LOAD THE STOLEN ITEMS INTO THE VEHICLE. I ASKED THE TWO SUSPECTS, LATER IDENTIFIED AS, MS VICTORIA SCUDIERO AND MS JAMIE WASHBURN, IF THEY HAD A RECEIPT FOR THE ITEMS THEY HAD IN THE SHOPPING CART, WHICH THEY REPLIED NO. BOTH SUSPECTS WERE READ MIRANDA AND UNDERSTOOD THEIR RIGHTS AND WISHED TO TALK TO ME AND ANSWER ANY QUESTIONS. I ASKED THE TWO SUSPECTS WHY THEY WERE OUTSIDE WITH THE SHOPPING CART IN WHICH THEY REPLIED THEY WERE LOOKING FOR CHRISTMAS TREES. I TOLD THE SUSPECTS THAT WALMART DOES NOT SELL CHRISTMAS TREES IN THE PARKING LOT AND THERE WERE NO TREES OUTSIDE THE STORE IN THE PARKING LOT BY THEIR VEHICLE AND THAT THE CHRISTMAS TREES ARE LOCATED INSIDE OF THE STORE. I THEN ASKED THEM IF THEY KNEW THEY WERE NOT SUPPOSED TO WALK OUT OF THE STORE PAST THE CASH REGISTERS AND ENTER THE PARKING LOT TO THEIR VEHICLE WITHOUT PAYING FOR THE MERCHANDISE IN WHICH THEY BOTH REPLIED YES. AFTER TALKING TO THE TWO SUSPECTS, I THEN TOLD DEFENDANT, MS VICTORIA SCUDIERO, SHE WAS BEING PLACED UNDER ARREST FOR RETAIL THEFT. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HER BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. |
