SUBMITTED BY: MULLINS, MARVIN 0493 (AR12124262) DID CORRUPT THE PUBLIC MORALS, OR OUTRAGE THE SENSE OF PUBLIC DECENCY, OR AFFECT THE PEACE AND QUIET OF PERSONS WHO MAY WITNESS THEM, OR ENGAGE IN BRAWLING OR FIGHTING, OR ENGAGED IN SUCH CONDUCT AS TO CONSTITUTE A BREACH OF PEACE OR DISORDERLY CONDUCT, IN VIOLATION OF FLORIDA STATE STATUTE 877.03; ON 010512 AT APPROXIMATELY 2330 HOURS, I WAS DISPATCHED TO THE AREA OF THE GATEHOUSE APARTMENTS IN INVERNESS AND HOFFMAN LANE IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL, I MADE CONTACT WITH THE VICTIM, MR HAROLD WATSON, WHO STATED HE WAS IN BED AND KEPT HEARING LOUD NOISES THAT SOUNDED LIKE FIREWORKS OR GUN SHOTS, AS WELL AS, OBSCENITIES BEING YELLED COMING FROM THE RESIDENCE DIRECTLY BEHIND HIS. THE VICTIM STATED THAT HE REPEATEDLY TRIED TO GO BACK TO SLEEP; HOWEVER, HE WAS UNABLE TO DO SO BECAUSE THE NOISE WOULD NOT STOP. AT THIS TIME, I DROVE FROM THE GATEHOUSE APARTMENTS TO HOFFMAN LANE, WHERE I MADE CONTACT WITH A WHITE MALE LATER IDENTIFIED AS THE DEFENDANT, MR VINCENT PACIFICO. THE DEFENDANT APPEARED TO BE EXTREMELY INTOXICATED, DUE TO HIS BLOODSHOT EYES, SLURRED SPEECH AND STAGGERED WALKING. AS SOON AS I EXITED MY PATROL VEHICLE, THE DEFENDANT IMMEDIATELY BEGAN YELLING OBSCENITIES AND TELLING ME TO GET OFF HIS PROPERTY. I EXPLAINED TO THE DEFENDANT THAT I WAS THERE TO INVESTIGATE LOUD NOISES AND YELLING. THE DEFENDANT JUST KEPT TELLING ME TO GET OFF HIS PROPERTY WHILE YELLING OBSCENITIES AND THAT I HAD NO IDEA WHAT I WAS TALKING ABOUT. I TOLD THE DEFENDANT TO QUIT YELLING, BECAUSE HE WAS DISTURBING HIS NEIGHBORS AND I JUST WANTED TO GET HIS SIDE OF THE STORY. THE DEFENDANT REFUSED TO QUIT YELLING AND HE WOULD NOT TELL ME WHAT THE NOISES WERE. I THEN TOLD THE DEFENDANT THAT I WAS LEAVING; HOWEVER, IF I KEPT RECEIVING MORE COMPLAINTS THAT I WOULD BE BACK. I THEN DROVE BACK TO THE GATEHOUSE APARTMENTS BECAUSE IMMEDIATELY AFTER I LEFT THE DEFENDANT'S RESIDENCE, VICTIM WATSON CALLED BACK IN TO THE SHERIFF'S OFFICE STATING THAT THE DEFENDANT WAS STILL CAUSING SUCH A NOISE BY SCREAMING AND YELLING THAT THE VICTIM'S FAMILY COULD NOT GO TO SLEEP. WHILE I WAS SPEAKING WITH THE VICTIM, I COULD HEAR THE DEFENDANT YELLING OBSCENITIES AND TURNING HIS MUSIC UP. AT THAT TIME, THE VICTIM STATED HE WISHED TO PRESS CHARGES AND COMPLETED A SWORN WRITTEN STATEMENT. DEPUTY STANTON, WHO WAS ALSO ON SCENE, WAS STANDING BETWEEN THE VICTIM'S APARTMENT AND THE DEFENDANT'S RESIDENCE AND COULD SEE THE DEFENDANT YELLING. A SHORT WHILE LATER WHILE I WAS SPEAKING WITH THE VICTIM, I HEARD DEPUTY STANTON YELL "SHERIFF'S OFFICE DROP THE GUN", AT WHICH TIME, THE DEFENDANT RAN INTO HIS RESIDENCE. I RAN TO ASSIST DEPUTY STANTON, WHO STATED THAT HE OBSERVED THE DEFENDANT WITH WHAT APPEARED TO BE A LARGE SILVER WOODEN HANDLE REVOLVER. APPROXIMATELY A MINUTE LATER, THE DEFENDANT CAME BACK OUT OF HIS RESIDENCE WITH WHAT APPEARED TO BE A LONG WOODEN RIFLE, AT WHICH TIME, DEPUTY STANTON ORDERED THE DEFENDANT TO DROP THE GUN TO WHICH HE COMPLIED. AT THIS TIME, I CLIMBED THE FENCE SEPARATING THE TWO PROPERTIES WITH MY TASER DRAWN AND ORDERED THE DEFENDANT TO THE GROUND. THE DEFENDANT COMPLIED AND AFTER HOLSTERING MY TASER, I PLACED THE DEFENDANT IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. A SHORT WHILE LATER, A SECOND VICTIM, MS SHARON BROWN, CAME OUTSIDE AND STATED THAT PRIOR TO OUR ARRIVAL, SHE DID HEAR LOUD NOISES THAT SOUNDED LIKE GUN SHOTS, AS WELL AS, OBSCENITIES BEING YELLED BY THE DEFENDANT, WHICH WERE DISTURBING HER AND AN NOT ALLOWING HER TO GO TO SLEEP. VICTIM BROWN ALSO COMPLETED A SWORN WRITTEN STATEMENT. I SECURED THE DEFENDANT IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING AND ADVISED HIM THAT HE WAS BEING CHARGED WITH BREACH OF PEACE. THE DEFENDANT 'S BOND SET AT $500.00 PER THE BOND SCHEDULE.
