| Probable cause affidavit: | SUBMITTED BY: LYNN, KURT 0349 (AR07100900) ON 122307 AT APPROXIMATELY 1725 HOURS, SERGEANT (SGT) BLOOMER WAS TRAVELING ON US HIGHWAY 41 IN THE AREA OF HERNANDO, AT WHICH TIME HE OBSERVED AN OLDER MODEL SILVER/GREY VAN ON US HIGHWAY 41. THE VEHICLE ALMOST STRUCK SGT BLOOMER'S VEHICLE AND CONTINUED SOUTH TOWARD PAUL STREET. SGT BLOOMER IMMEDIATELY TURNED AROUND AND, WHILE CATCHING UP TO THE VEHICLE, OBSERVED THE VEHICLE LEAVE THE ROADWAY SEVERAL TIMES. HE PERFORMED A TRAFFIC STOP ON THE VEHICLE ON NORTH PAUL DRIVE. UPON MAKING CONTACT WITH THE DRIVER, MS VIRGINIA L FRALEY, SGT BLOOMER OBSERVED SEVERAL CONDITIONS INDICATING THAT THE DRIVER MIGHT BE IMPAIRED. AT THAT TIME, HE CALLED FOR A TRAFFIC UNIT AND THIS DEPUTY RESPONDED IMMEDIATELY. UPON CONTACT WITH THE DRIVER, I IMMEDIATELY SMELLED A STRONG ODOR OF ALCOHOL. THE DRIVER WAS SWAYING BAck and forth while sitting in her van. SHE was slurring her speech and seemed very confused. she did state that she had had a couple of drinks. i immEdIATELY aSked the driver to perform field sobriety tasks. SHE tried to complete the horizontal gaze nystagmus, the one leg stand and the finger to nose tasks. however, the driver was too intoxicated to follow instructions and, after the third attempt at FIELD SOBRIETY TASKS ,the driver was placed in hand restraints (douBle locked) and placed in the rEar of my patrol veHicle. she was immediately read miranda WARNINGS and implied consent and was transported to the citrus county detention facility to submit to the approved test of her breath for the purpose of determining the alcohol content of her blood. AT APPROXIMATELY 1848 HOURS, THE DRIVER WAS OFFERED BY CORRECTIONS CORPORATION OF AMERICA (CCA) INTOXILYZER OPERATOR TO GIVE A SAMPLE OF HER BREATH FOR IMPAIRMENT RESULTS. SHE DID REFUSE AND will BE CHARGED WITH REFUSAL TO SUBMIT TO THE REQUIRED BREATH TEST. THE DRIVER WAS ISSUED A CITATION FOR CARELESS DRIVING. IT SHOULD BE NOTED THE DRIVER HAS A PREVIOUS CHARGE OF DRIVING UNDER THE INFLUENCE IN CITRUS COUNTY. BOND SET PER SCHEDULE. *NOT-EXEMPT* |
