SUBMITTED BY: PRUS, CHRISTOPHER 0339 (AR09107212) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: THE VICTIMS' RESIDENCE, LOCATED AT 4206 SOUTH HAZELTON TERRACE, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIMS, WITHOUT SAID PERSONS' CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(1) AND 810.02(3)(A) AND DID UNLAWFULLY HAVE IN HIS POSSESSION A TOOL, MACHINE OR IMPLEMENT, TO WIT: APPROXIMATELY TWELVE INCH LETTER OPENER WITH THE INTENT TO USE THE SAME OR ALLOW THE SAME TO BE USED TO COMMIT ANY BURGLARY OR TRESPASS IN VIOLATION OF FLORIDA STATE STATUTE 810.06 AND did knowingly, actually and intentionally touch or strike DEPUTY PRUS AND DEPUTY STEVE SMITH, LAW ENFORCEMENT OFFICERS, against the will of that person while knowing that said OFFICERS WERE engaged in a lawful performance of THEIR legal duties, in violation of Florida Statute 784.07 AND DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY PRUS AND DEPUTY SMITH, WHO WERE THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: ATTEMPTING TO TAKE THE DEFENDANT INTO CUSTODY, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSONS OF SUCH OFFICERS, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 011609, I RESPONDED TO 4206 SOUTH HAZLETON TERRACE IN REFERENCE TO A BURGLARY IN PROGRESS. UPON ARRIVAL, MYSELF AND DEPUTY SMITH WERE INSTRUCTED THAT THE DEFENDANT (LATER IDENTIFIED AS MR WALLACE MATTSON), HAD RETREATED TO THE WOODED AREA WEST OF THE RESIDENCE. UPON ENTERING THE WOODED AREA, I OBSERVED A WHITE MALE APPROXIMATELY 5'10" TO 5'11", MEETING THE DESCRIPTION OF THE DEFENDANT. AT THAT TIME, I INSTRUCTED HIM TO STOP, CALLING OUT THAT I WAS WITH THE SHERIFF'S DEPARTMENT. AT THAT TIME, THE DEFENDANT LOOKED AT MYSELF AND TOOK OFF RUNNING. THIS DEPUTY AND DEPUTY STEVE SMITH THEN PURSUED THE DEFENDANT APPROXIMATELY 100 YARDS, AT WHICH TIME, THE DEFENDANT TURNED AND SQUARED OFF WITH MYSELF AND DEPUTY SMITH. WHEN INSTRUCTED TO GET ON THE GROUND, THE DEFENDANT BEGAN SHAKING HIS FISTS AND WALKING TOWARDS THIS DEPUTY, AT WHICH TIME, I PREFORMED A LEG SWEEP AND TOOK THE DEFENDANT TO THE GROUND. AT THAT TIME, DEPUTY SMITH AND MYSELF HAD A SHORT ALTERCATION WITH THE DEFENDANT AND THEN TOOK THE DEFENDANT IN TO CUSTODY. DURING THE ALTERCATION THE DEFENDANT REFUSED TO FOLLOW INSTRUCTIONS OF PUTTING HIS HANDS BEHIND HIS BACK, AT WHICH TIME, THE DEFENDANT WAS DRIVE STUNNED BY DEPUTY SMITH. WHILE BEING TASED, THE DEFENDANT REACHED BEHIND, GRABBING DEPUTY SMITH'S TASER, AT THE SAME TIME, GRABBING DEPUTY SMITH'S FINGER, CAUSING INJURY TO DEPUTY SMITH. DURING SAME ALTERCATION, THIS DEPUTY RECEIVED SEVERAL SCRATCH MARKS ON BOTH HANDS, DRAWING BLOOD FROM BOTH. THE DEFENDANT WAS THEN TAKEN INTO CUSTODY AND HANDCUFFS WERE APPLIED, DOUBLE LOCKED. CONTACT WAS MADE WITH THE VICTIMS AT WHICH TIME, THEY STATED THAT AT APPROXIMATELY 1415 HOURS, THEY LOOKED OUT THEIR WINDOW AT WHICH TIME, THEY OBSERVED THE DEFENDANT LOOKING INTO THEIR RESIDENCE. THE VICTIMS ADVISED THAT THEY THEN WATCHED THE DEFENDANT ATTEMPT TO GAIN ENTRY INTO THE SCREENED GARAGE DOOR. WHEN THE DEFENDANT WAS UNABLE TO MAKE ENTRY, THE DEFENDANT THEN WENT TO THE FRONT SCREEN DOOR FOR ENTRY. THE VICTIMS STATED THEY THEN TOOK A PICTURE OF THE DEFENDANT ATTEMPTING TO MAKE ENTRY. PHOTO CARD FROM THE VICTIMS' CAMERA WAS TAKEN IN TO CUSTODY AND PLACED IN EVIDENCE. THE DEFENDANT WAS THEN CHECKED FOR WEAPONS AT WHICH TIME, A TWELVE INCH LETTER OPENER WAS FOUND IN HIS RIGHT COAT JACKET. THE LETTER OPENER WAS TURNED INTO EVIDENCE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HE WAS CHARGED WITH BURGLARY, POSSESSION OF BURGLARY TOOLS, TWO COUNTS OF BATTERY ON A LAW ENFORCEMENT OFFICER AND ONE COUNT OF OBSTRUCTION OF JUSTICE WITH A TOTAL BOND OF $36,500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
