SUBMITTED BY: LYNN, KURT 0349 (AR07100055) ON 102607, I HAD BEEN COMPLETING A TRAFFIC STOP ON MARGARET DRIVE IN DUNNELLON WHEN I OBSERVED A BLACK UNKNOWN VEHICLE TURNING DOWN SEVERAL STREETS OFF OF MARGARET DRIVE AND IMMEDIATELY BACKING OUT OF THOSE STREETS. UPON CONCLUDING THE TRAFFIC STOP, I TRAVELED IN THE GENERAL DIRECTION THE VEHICLE HAD LAST TRAVELED ON, WHICH WAS WEST HENRY BLAIR LANE. AS THE VEHICLE REACHED THE CORNER OF WEST HENRY BLAIR LANE AND NORTH OSBORNE AVENUE, I OBSERVED A BLACK MALE SUBJECT JUMP OUT OF THE VEHICLE'S REAR DRIVER SIDE DOOR. THE BLACK MALE WAS WEARING JEANS, A WHITE SHIRT AND BROWN BOOTS. THE BLACK MALE RAN OVER TO TWO TREES APPROXIMATELY FIFTEEN (15) FEET FROM THE ROADWAY, STOPPED FOR A MOMENT AND THEN RAN BACK OVER TO THE SIDE OF THE ROADWAY WHERE HE STARTED CASUALLY WALKING AND PULLED A CELLULAR TELEPHONE FROM HIS RIGHT FRONT JEANS POCKET AND BEGAN TALKING. THE BLACK VEHICLE HAD PULLED AWAY AND LEFT THE AREA. I STOPPED AND BEGAN A CONVERSATION WITH THE BLACK MALE AND ASKED FOR HIS IDENTIFICATION, TO WHICH HE PRESENTED A FLORIDA IDENTIFICATION CARD, IDENTIFYING HIM AS MR WALTER JAMES GOOLSBY, JUNIOR, FROM ORLANDO, FLORIDA. I ASKED THE BLACK MALE FOR INFORMATION AS TO WHY HE WAS IN THE AREA, TO WHICH HE STATED HE LIVED IN THE DUNNELLON AREA AFTER HAVING just BEEN RELEASED FROM THE FLORIDA DEPARTMENT OF CORRECTIONS. HE STATED THAT HE HAD SERVED SIXTEEN (16) MONTHS OF AN EIGHTEEN (18) MONTH SENTENCE FOR POSSESSION AND SALE OF COCAINE. THE BLACK MALE SUBJECT ALSO STATED HE WAS UNEMPLOYED, WAS NOT LOOKING FOR A JOB AND THAT HE WAS JUST TRYING TO GET USED TO LIFE ON THE OUTSIDE. AT THAT TIME, DEPUTY PRICE PULLED UP ON SCENE. MR GOOLSBY WAS ASKED BY THIS DEPUTY IF HE HAD ANYTHING ILLEGAL IN HIS POSSESSION, TO WHICH HE STATED NO AND PULLED HIS POCKETS INSIDE OUT, OFFERING THIS DEPUTY A FULL SEARCH OF HIS PERSON. A QUICK PAT DOWN SEARCH FOR WEAPONS, FOR OFFICER SAFETY, WAS PERFORMED AND NO WEAPONS WERE FOUND. DURING THE ENTIRE ENCOUNTER, MR GOOLSBY APPEARED NERVOUS AND DISTRACTED. HOWEVER, AFTER OBTAINING INITIAL PERSON CONTACT INFORMATION, HE WAS ALLOWED TO WALK AWAY FROM THE SCENE. THIS DEPUTY THEN WALKED OVER TO THE TREES WHICH MR GOOLSBY HAD WALKED BY AND LOOKED AT AFTER THE CONSENSUAL ENCOUNTER. I SHINED MY LIGHT IN THE AREA WHERE MR GOOLSBY HAD STOPPED EARLIER, PRIOR TO OUR ENCOUNTER. IN THAT IMMEDIATE LOCATION I FOUND THREE BAGGIES WHICH CONTAINED TWENTY-NINE (29) GRAMS OF COCAINE IN ONE BAGGIE, SEVEN GRAMS OF COCAINE IN THE SECOND BAGGIE AND FOUR GRAMS OF COCAINE IN THE THIRD BAGGIE. THERE WAS ALSO ONE BAGGIE WITH APPROXIMATELY SEVEN GRAMS OF MARIJUANA AND ONE PRESCRIPTION BOTTLE, WITH NO LABELING, CONTAINING APPROXIMATELY 1.1 GRAMS OF CRACK COCAINE. AT THAT TIME, MR GOOLSBY WAS JUST TURNING THE CORNER TO WALK WEST ON WEST HENRY BLAIR LANE. HE WAS ORDERED BY THIS DEPUTY AND DEPUTY PRICE TO STOP AND LAY DOWN ON THE GROUND, TO WHICH HE COMPLIED. HE WAS PLACED IN HAND RESTRAINTS (DOUBLE LOCKED) BEHIND HIS BACK. UPON COMPLETING A FULL PAT DOWN SEARCH, INCIDENT TO ARREST, A BAGGIE WAS FOUND IN HIS RIGHT FRONT JEANS POCKET WHICH CONTAINED NINE LARGE WHITE PILLS, LATER IDENTIFIED AS HYDROCODONE; ONE FULL XANAX PILL ALONG WITH NUMEROUS CRUSHED XANAX PILLS. IN ADDITION, THE BAGGIE HAD BEEN TIED WITH A LOOSE KNOT AT THE TOP AND INSIDE THE KNOT WAS A SMALL AMOUNT OF A WHITE POWDERY SUBSTANCE BELIEVED TO BE COCAINE. ALSO FOUND DURING THE PAT-DOWN SEARCH, IN HIS LEFT FRONT JEANS POCKET, WERE SEVEN ONE HUNDRED DOLLAR BILLS AND TWELVE TWENTY DOLLAR BILLS. MR GOOLSBY WAS INFORMED OF HIS MIRANDA RIGHTS AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. AT THAT TIME, MR GOOLSBY STATED THAT HE WAS SORRY ABOUT HAVING THE PILLS AND THAT HE HAD BOUGHT THE "XANIES" AND "HYDROS" FROM SOME GUY ON THE STREET. HE THEN DENIED ANY KNOWLEDGE OF THE OTHER DRUGS FOUND WHERE HE HAD BEEN SEEN STANDING AND AGAIN STATED HE WAS UNEMPLOYED. IT SHOULD BE NOTED THAT THE WEATHER WAS MOIST AND RAINY; THE GROUND WAS WET AND THERE WAS OTHER LITTER AROUND THE TREES THAT WAS COVERED WITH WETNESS. HOWEVER, THE BAGGIES CONTAINING THE MARIJUANA, COCAINE AND CRACK COCAINE WERE ALL DRY. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY, MR GOOLSBY OFFERED NO FURTHER STATEMENTS WITH THE EXCEPTION OF "I GOT A JOB. I WORK HARD" AFTER BEING TOLD THE MONEY FOUND IN HIS POSSESSION WOULD BE SEIZED AND FORFEITED UNDER THE FLORIDA CONTRABAND FORFEITURE ACT. WHEN ASKED WHAT JOB PAYS SO WELL, HE REPLIED "SAME THING AS I DID BEFORE." BOND SET PER SCHEDULE. *NOT-EXEMPT* |
