SUBMITTED BY: FARMER, MARK 0452 (AR09110576) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: REMOVED METAL CAR PART RACKS FROM THE BUSINESS, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: $1,000.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(C)(1); ON 082009 AT 1103 HOURS, I WAS ON ROUTINE PATROL OF COMMERCIAL BUSINESSES AND WAS PATROLLING 915 NORTH SUNCOAST BOULEVARD, THE LOCATION OF JOHNSON BROTHERS SUZUKI, WHEN I OBSERVED A WHITE MALE AND WHITE FEMALE INSIDE A BLUE DODGE PICKUP TRUCK WITH AN ATTACHED TRAILER LOADED WITH METAL. THIS APPEARED SUSPICIOUS, SINCE THE BUSINESS WAS CLOSED AND THERE WAS NO ACCESS POINT THAT WAS COMMONLY USED ON THE NORTH SIDE OF THE BUSINESS. I OBSERVED THE MALE SUSPECT STOP AND EXIT HIS VEHICLE AND MAKE CONTACT WITH ME. THE SUSPECT IMMEDIATELY MADE SPONTANEOUS UTTERANCES TO ME, ADVISING THAT HE WAS SORRY AND THAT THE STUFF WAS ABANDONED, AND THAT TIMES WERE SO TOUGH HE WAS "JUST TRYING TO MAKE A BUCK." I THEN OBSERVED ANOTHER SUBJECT DRIVE UP BEHIND ME IN A WHITE MINIVAN. THAT SUBJECT WAS LATER IDENTIFIED AS THE OWNER OF THE BUSINESS AND THE VICTIM. THIS SUBJECT ADVISED THAT HE WAS IN THE PROCESS OF RETRIEVING METAL CAR PART RACKS THAT WERE LOCATED ON THE NORTH SIDE OF THE BUSINESS AND ADVISED THE SUSPECTS WERE, IN FACT, STEALING FROM HIM. THE VICTIM ADVISED HE HAD MORE THAN $1,000.00 OF METAL VEHICLE PART RACKS PALLETIZED ON THE NORTH SIDE OF THE BUSINESS AND ADVISED NOT ONLY WERE THE SUSPECTS IN THE PROCESS OF STEALING FROM HIM, BUT IT APPEARED THAT THEY HAD MADE AN ADDITIONAL TRIP. THE VICTIM VERIFIED THAT THE RACKS WERE IN PLACE ON 081809 AND BELIEVED THE DATE OF THEFT TO BETWEEN 081809 AT 1200 AND BEFORE 1100 HOURS ON 081909. THE MALE SUSPECT PROVIDED ME WITH A SALES RECEIPT FROM INTER-COUNTY RECYCLING WHERE HE HAD ALREADY SOLD ONE LOAD OF CAR PART RACKS, WEIGHING UP TO 1,480 POUNDS AND WAS PAID $92.50. THE METAL WAS CLASSIFIED BY INTER-COUNTY AS "FE HMS NUMBER TWO STEEL." THE RECEIPT ADVISED THE TRANSACTION OCCURRED ON 081909 AT 1054 HOURS, AND THE MALE SUSPECT'S NAME, ADDRESS AND SIGNATURE APPEARED ON THE BOTTOM OF THE RECEIPTS. THE RECEIPTS WERE COLLECTED AND WILL BE TURNED INTO RECORDS. THE FEMALE CODEFENDANT ADVISED THAT SHE WAS ALSO SORRY, BUT DID NOT ADVISE ANYTHING FURTHER REFERENCE THE THEFT. THE SUSPECT'S VEHICLE AND TRAILER WERE RELEASED TO FAMILY MEMBERS AND PHOTOGRAPHS WERE TAKEN OF THE METAL CAR RACKS, SEE CRIME SCENE TECHNICIAN (CST) REPORT. THE VICTIM ADVISED HE DID WISH TO PURSUE CRIMINAL CHARGES. BOTH SUSPECTS WERE ARRESTED, DOUBLE LOCKED AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE VICTIM ADVISED THAT HE DID NOT BELIEVE THE SUSPECTS HAD ENTERED THE BUILDING AND WOULD ADVISE IF ANY OTHER PROPERTY WAS TAKEN REFERENCE THIS CASE. THE VICTIM WAS ISSUED AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER. *NOT-EXEMPT* |
