| Probable cause affidavit: | SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR10117094) THE DEFENDANT WAS PLACED ON PROBATION IN PASCO COUNTY ON 081910 FOR DRIVING WITH HER LICENSE SUSPENDED AS A HABITUAL OFFENDER. THE DEFENDANT DID VIOLATE THE TERMS OF HER PROBATION IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 948.06, TO WIT: SHE HAD A SPECIAL CONDITION OF HOME CONFINEMENT AND WAS OUT OF HER RESIDENCE ON 090410 AT APPROXIMATELY 0220 HOURS. THE DEFENDANT WAS ALSO EXTREMELY INTOXICATED AT THAT TIME. ON 090410 AT APPROXIMATELY 0220 HOURS, I INITIATED A TRAFFIC STOP ON A 1989 WHITE FOUR DOOR FORD VEHICLE, BEARING FLORIDa LICENSE PLATE V662UA. UPON MAKING CONTACT WITH the DRIVER AND TWO PASSENGERS IT WAS DISCOVERED THAT oNE OF THE PASSENGERS, DEFENDANT ms WHITNEY ECKERT, WAS ON PROBATION WITH A SPECIAL CONDITION THAT SHE WAS SUBJECT TO HOME CONFINEMENT. UPON MAKING CONTACT WITH THE DEFENDANT I INQUIRED ABOUT HER HOME CONFINEMENT. SHE STATED THAT SHE HAD GONE TO THE BUZZ BAR, LOCATED ON U S HIGHWAY 19 IN CRYSTAL RIVER TO PICK UP A FRIEND. I COULD SMELL A STRONG ODOR OF ALCOHOL ON THE DEFENDANT'S BREATH AND HER WORDS WERE ALSO SLURRED. I CONDUCTED A FIELD INTERVIEW REPORT ON THE DEFENDaNT DUE TO THE FACT THAT I WAS UNABLE TO CONTACT HER PROBATION OFFICER, MS PAMELA RAINES. THE DEFENDANT WAS THEN RELEASED AND THIS DEPUTY WOULD FOLLOW UP WITH THE PROBATION OFFICER AT A LATER DATE. ON 092810, I CONTACTED PROBATION OFFICER MS PAMELA RAINES IN REFERENCE TO FOLLOWING UP ON THE DEFENDANT VIOLATING HER PROBATION. MS RAINES wAS UNAWARE THAT I HAD MADE CONTACT WITH HER THAT MORNING AND UPON DISCUSSING THE INFORMATION I RELAYED TO HER, SHE STATED for me to MAKE A PROBABLE CAUSE ARREST DUE TO THE FACT THE DEFENDANT WAS ON HOME CONFINEMENT AND THAT SHE WAS EXTREMELY INTOXICATED. I THEN RESPONDED TO 1316 NORTHEAST 5TH AVENUE IN CRYSTAL RIVER. I MADE CONTACT WITH THE DEFENDANT AND INFORMED HER SHE WAS BEING PLACED UNDER ARREST FOR VIOLATING HER PROBATION. SHE REQUESTED TO CALL HER PROBATION OFFICER WHILE I STOOD BY. WHILE SHE WAS oN THE TELEPHONE WITH MS RAINES SHE STATED THAT SHE ONLY WENT TO THE BUZZ BAR FOR 15 MINUTES, and THAT SHE ONLY HAD A COUPLE DRINKS, BUT SHE WAS INTOXICATED DUE TO THE FACT SHE IS A LIGHT WEIGHT. SHE STATED SHE WAS SORRY AND KNEW SHE DID WRONG. THE dEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTIoN FACILITY AND TURNED OVER TO DETENTIoN FACILITY STAFF, WHERe HER BOND WAS SET AT NO BOND PER PROBATION OFFICER RAINES.
