Probable cause affidavit: | SUBMITTED BY: RICCI, ANTHONY 0606 (AR08106710) did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct, in that DEFENDANT (A) did GET OUT OF A MOVING VEHICLE AND BEGAN YELLING AND SCREAMING, in violation of Florida Statute 877.03; ON 121508 AT 0220 HOURS I ARRIVED ON SCENE IN THE AREA OF HOMOSASSA TRAIL AND PITTSBURG IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL I MADE CONTACT WITH THE DEFENDANT, MR WILLIAM EASTERLY, AND A WITNESS. BOTH OF WHOM STATED THEY WERE IN A VERBAL ARGUMENT AND WAITING FOR THEIR SISTER TO COME AND PICK THEM UP. I MADE CONTACT WITH THE DEFENDANT AND ASKED HIM WHAT HAD OCCURRED, TO WHICH HE WAS VISIBLY UPSET STATING HIS GIRLFRIEND, THE WITNESS, HAD CHEATED ON HIM. THE DEFENDANT APPEARED TO BE VERY AGITATED AND OFTEN SCREAMING IN A MANNER TO VENT HIS FRUSTRATION. I THE INSTRUCTED THE DEFENDANT TO STOP SCREAMING, WHERE I HAD TO ASK MULTIPLE TIMES. I THEN MADE CONTACT WITH THE COMPLAINANT WHO IS THE WITNESSES SISTER. I SPOKE WITH HER IN REFERENCE TO GIVING THE DEFENDANT AND WITNESS A RIDE HOME, WHERE SHE ARRIVED SHORTLY THEREAFTER. I THEN RAN THE WITNESS, COMPLAINANT AND THE DEFENDANT IN FCIC/NCIC WHICH CAME BACK WITH NEGATIVE RESULTS. AT THAT TIME I TURNED THE DEFENDANT AND WITNESS OVER TO THE COMPLAINANT FOR A RIDE HOME. UPON THE COMPLAINANT LEAVING, I STOOD BY IN THE AREA OF HOMOSASSA TRAIL AND PITTSBURG WHERE I OVERHEAD YELLING AND SCREAMING WHICH SOUNDED LIKE THE DEFENDANT. AT THAT TIME I APPROACHED THE DEFENDANT WHO STATED TO ME THAT HE WAS TRYING TO LOOK FOR HIS SHIRT WHICH WAS SOMEWHERE ON THE ROADWAY. I THEN HANDCUFFED THE DEFENDANT, DOUBLE LOCKED BEHIND HIS BACK, AND SECURED HIM IN THE REAR SEAT OF MY PATROL VEHICLE. I MADE CONTACT AGAIN WITH THE COMPLAINANT, WHO ADVISED THAT UPON LEAVING THE DEFENDANT BEGAN ARGUING WITH THE WITNESS AGAIN, BECOMING VERY UPSET AND STATED TO THE COMPLAINANT THAT HE WANTED TO LOOK FOR HIS SHIRT AND AT THAT TIME THE DEFENDANT OPENED HIS DOOR WHILE THE VEHICLE WAS IN MOTION AND JUMPED OUT OF THE VEHICLE. THE COMPLAINANT ADVISED SHE TURNED AROUND TO PICK THE DEFENDANT BACK UP WHERE HE BEGAN YELLING AND SCREAMING AT THE WITNESS. THE COMPLAINANT WAS GIVEN A STATEMENT FORM WHICH SHE FILLED OUT AND WHICH WILL BE TURNED OVER TO RECORDS. I THEN INSTRUCTED THE DEFENDANT HE WAS UNDER ARREST FOR DISORDERLY CONDUCT. HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACULTY. ALL PARTIES WERE GIVEN CASE CARDS. *NOT-EXEMPT* |
