SUBMITTED BY: TULLY, JAMES 1342 \t(AR16-20359) DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY TULLY (1342), WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: THE DEFENDANT EXITED HIS VEHICLE AND ATTEMPTED TO RUN FROM DEPUTY TULLY ON FOOT, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02, AND DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 072316, AT APPROXIMATELY 1145 HOURS, WHILE CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF CONSTITUTION BOULEVARD AND MONROE STREET WEST, I OBSERVED A BLACK FORD EXPLORER APPROACH the STOP SIGN AT JEFFERSON STREET WEST AND CONSTITUTION BOULEVARD AMD FAIL TO COME TO A COMPLETE STOP AT the STOP SIGN LOCATED AT THAT INTERSECTION. AS the VEHICLE TURNED NORTH ONTO CONSTITUTION BOULEVARD IT BEGAN TRAVELLING TOWARDS THIS DEPUTY. THE VEHICLE THEN TURNED RIGHT ONTO MADISON STREET WEST and BEGAN TRAVELLING EASTBOUND. AT THAT TIME, I TURNED ONTO MADISON STREET WEST APPROXIMATELY 30 FEET BEHIND the BLACK FORD EXPLORER BEARING FLORIDA LICENSE PLATE NUMBER K692PL. AS I POSITIONED MY MARKED AGENCY VEHICLE BEHIND SAID BLACK EXPLORER THE VEHICLE BEGAN TO TAKE OFF AT A HIGH RATE OF SPEED. I ESTIMATED the VEHICLE'S SPEED TO BE APPROXIMATELY 60 TO 70 MILES PER HOUR (MPH) IN A POSTED 25 MPH SPEED ZONE. IT SHOULD BE NOTED, THIS DEPUTY HAD NOT ACTIVATED HIS EMERGENCY LIGHTS OR EQUIPMENT AT THAT TIME. I ATTEMPTED TO CATCH UP TO the VEHICLE AND AFTER APPROXIMATELY 300 YARDS the VEHICLE BRAKED VERY HARD and TURNED IN TO THE RESIDENCE LOCATED 2814 MADISON STREET WEST IN INVERNESS. DUE TO the VEHICLE TRAVELLING AT SUCH A HIGH RATE OF SPEED, THE VEHICLE'S BRAKES LOCKED UP CAUSING SKID MARKS ON the STREET IN FRONT OF THE RESIDENCE GOING THROUGH THE FRONT GRASS OF the RESIDENCE AND ACROSS the DRIVEWAY OF THE RESIDENCE BEFORE STOPPING NEXT TO A FENCE LOCATED ON THAT PROPERTY. AT THAT TIME, I PULLED IN BEHIND the SAID VEHICLE AND ACTIVATED MY EMERGENCY LIGHTS. THE VEHICLE HAD HIT THE 8 FOOT TALL WOODEN FENCE BESIDE the RESIDENCE LOCATED AT THAT RESIDENCE KNOCKING the MIRROR OF THE VEHICLE INTO THE INWARD POSITION. AS I EXITED MY PATROL VEHICLE, I OBSERVED A WHITE MALE WHO I RECOGNIZED AS the DRIVER / DEFENDANT, MR WILLIAM LEE GAMBLE, JR, EXIT the DRIVER'S SIDE DOOR AND BEGAN RUNNING IN A WESTERLY DIRECTION AWAY FROM THIS DEPUTY. I THEN GAVE APPROXIMATELY THREE LOUD VERBAL COMMANDS TO the DEFENDANT "SHERIFF'S OFFICE STOP RUNNING!" the DEFENDANT THEN STOPPED RUNNING AND STATED "I GIVE UP." THE DEFENDANT THEN THREW the VEHICLE'S KEYS FROM HIS LEFT HAND INTO the YARD OF the RESIDENCE AND LAID DOWN ON HIS STOMACH. the DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN the REAR OF MY PATROL VEHICLE. DURING THIS INCIDENT, THIS DEPUTY DID NOT LOSE SIGHT OF THE VEHICLE, NOR DID I OBSERVE ANYONE OTHER THAN the DEFENDANT EXIT the VEHICLE. AT THAT TIME, I MADE CONTACT WITH THE DEFENDANT, WHO WAS SEATED IN THE REAR OF MY PATROL VEHICLE AND ADVISED HIM FOR THE REASON WHY I HAD STOPPED HIM. the DEFENDANT STATED HE UNDERSTOOD AND that HE ADMITTED TO TRYING TO AVOID THIS DEPUTY BECAUSE HIS LICENSE IS SUSPENDED. THE DEFENDANT THEN PROVIDED ME WITH his NAME AND DATE OF BIRTH. UPON RUNNING the DEFENDANT THROUGH THE CITRUS COUNTY SHERIFF'S OFFICE TELETYPE, IT WAS LEARNED THAT THE DEFENDANT'S DRIVING PRIVILEGES HAD BEEN SUSPENDED ON 022613 FOR FAILURE TO PAY finANCIAL OBLIGATIONS. AT THAT TIME, I ADVISED THE DEFENDANT THAT HE WAS GOING TO BE PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED AND ALSO FOR RESISTING THIS OFFICER WITHOUT VIOLENCE FOR ATTEMPTING TO RUN FROM THIS DEPUTY. A SEARCH OF THE DEFENDANT'S VEHICLE WAS CONDUCTED WITH HIS CONSENT, which WAS MET with NEGATIVE RESULTS. AT THAT TIME, DEPUTY CROSNOE (0234) STOOD BY WITH THE DEFENDANT'S VEHICLE UNTIL IT COULD BE REMOVED BY A TOW COMPANY. AT THAT TIME, I BEGAN TO TRANSPORT THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. WHILE TRAVELLING SOUTHBOUND ON NORTH INDEPENDENCE HIGHWAY, the DEFENDANT BEGAN SCREAMING THAT HE WAS HAVING SEIZURES and CHEST PAINS. AT THAT TIME, I PULLED INTO the DUKE ENERGY OFFICE LOCATED AT NORTH INDEPENDENCE HIGHWAY and GULF TO LAKE HIGHWAY. AT THAT TIME, THE DEFENDANT WAS REMOVED FROM the VEHICLE BY THIS DEPUTY, ALONG WITH THE ASSISTANCE OF SERGEANT FISCHER (0163) AND DEPUTY SNEDEKER (1402). WHILE STANDING BY WITH THE DEFENDANT WAITING ON EMERGENCY MEDICAL SERVICES (EMS) TO ARRIVE, THE DEFENDANT WAS SWEATING HEAVILY and APPEARED TO BE UNDER THE INFLUENCE OF AN UNKNOWN SUBSTANCE. UPON THE ARRIVAL OF EMS, MEDIC UNIT116 THEN TRANSPORTED the DEFENDANT TO CITRUS MEMORIAL HOSPITAL TO BE EVALUATED. THIS DEPUTY FOLLOWED EMS TO the HOSPITAL. UPON ARRIVAL, THE DEFENDANT WAS MEDICALLY CLEARED BY STAFF AND RELEASED TO THIS DEPUTY TO BE TAKEN TO the CITRUS COUNTY DETENTION FACILITY. WHILE STANDING BY AT THE HOSPITAL with THE DEFENDANT HE SPONTANEOUSLY UTTERED TO THIS DEPUTY THAT HE HAD SMOKED CRYSTAL METHAMPHETAMINE AND HAD CONSUMED APPROXIMATELY 1 METHADONE PILL EARLIER TODAY PRIOR TO ME PULLING HIM OVER. AT THAT TIME, THE DEFENDANT WAS THEN TRANSPORTED TO THE DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS TURNED OVER TO STAFF WHERE HE WAS CHARGED WITH ONE COUNT RESISTING WITHOUT VIOLENCE WITH BOND SET AT $1,000.00 AND ONE COUNT DRIVING WHILE LICENSE SUSPENDED, REVOKED OR CANCELLED WITH BOND SET AT $500.00. THE DEFENDANT'S TOTAL BOND WAS SET AT $1,500.00, PER THE BOND SCHEDULE. the DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER A21DQZP, FOR DRIVING WHILE LICENSE SUSPENDED, CANCELLED OR REVOKED WITH A MANDATORY COURT DATE OF 081116 AT 1300 HOURS. the DEFENDANT WAS ALSO ISSUED A WRITTEN WARNING, WARNING NUMBER 409839B, FOR the STOP SIGN VIOLATION. NO FURTHER ACTION WAS TAKEN BY THIS DEPUTY AT THIS TIME. |
