SUBMITTED BY: JOHNSON, DALE 0178 (AR08102546) DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(3)(A), BOND SET AT $10,000.00, PER THE BOND SCHEDULE; AND DID KNOWINGLY, WHILE HIS OPERATOR'S OR CHAUFFEUR'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE UPON THE HIGHWAYS OF THIS STATE, (HABITUAL OFFENDER) IN VIOLATION OF FLORIDA STATE STATUTE 322.34(5), BOND SET AT $2,000.00, PER THE BOND SCHEDULE; AND DID VIOLATE FLORIDA STATE STATUTE NUMBER 316.192(3)(C)(1), FOR DRIVING A MOTOR VEHICLE ON THE HIGHWAYS OF THIS STATE IN A RECKLESS MANNER, BOND SET AT $250.00, PER THE BOND SCHEDULE. ON 040508 AT APPROXIMATELY 0900 HOURS, I OBSERVED A 1989 FORD RANGER, RED IN COLOR, TRAVELING NORTHBOUND ON NORTH CROFT AVENUE IN THE AREA OF EAST DAWSON DRIVE TRAVELING 42 MILES PER HOUR (MPH) IN A 30 MPH POSTED SPEED ZONE. I PULLED OUT AND POSITIONED MY PATROL VEHICLE BEHIND THE FORD RANGER. THE DRIVER TURNED ONTO EAST ROBERT STREET AND AT THAT TIME I INITIATED A TRAFFIC STOP UTILIZING MY OVERHEAD RED AND BLUE LIGHTS. THE VEHICLE CONTINUED ON EAST ROBERT STREET, TURNED LEFT ONTO NORTH FITZPATRICK AVENUE AND CONTINUED NORTH REFUSING TO STOP. AT THAT TIME, I ACTIVATED MY SIREN AND ADVISED DISPATCH THE VEHICLE HAD REFUSED TO STOP. THE VEHICLE ACCELERATED TO APPROXIMATELY 55 MPH. AS IT SLOWED WHILE APPROACHING GLADYS STREET, THE VEHICLE LEFT THE ROAD ONTO THE RIGHT-HAND SHOULDER OF THE ROAD, RAN OVER THE STOP SIGN AND THEN TURNED EAST ON EAST GLADYS STREET. THE VEHICLE THEN TURNED NORTH ON NORTH SONIA AVENUE, THEN WEST ON EAST MARCIA STREET AT 60 MPH, BACK TOWARD NORTH CROFT AVENUE. THE VEHICLE THEN TURNED NORTH ON CROFT AVENUE THEN EAST ONTO EAST CROWN DRIVE TO THE DEAD END WHERE THE VEHICLE CONTINUED THROUGH A CHAIN LINK FENCE AT THE END OF CROWN DRIVE INTO A WOODED AREA. I CONTINUED TO FOLLOW THE VEHICLE WITH MY LIGHTS AND SIREN ACTIVATED THROUGH THE WOODED AREA TO A POWER LINE EASEMENT. THE VEHICLE CONTINUED NORTH ON THE POWER LINE EASEMENT, CRASHED THROUGH A GATE LOCATED BEHIND 1635 NORTH CROFT AVENUE THEN ONTO A DRIVEWAY AND BACK OUT ONTO NORTH CROFT AVENUE. THE VEHICLE THEN TURNED SOUTH ONTO CROFT AVENUE THEN WEST ONTO EAST MARY LUE STREET, SOUTH ONTO NORTH MICHELLE TERRACE AND THEN RIGHT ONTO EAST CAMBRIDGE LANE WHERE HE CROSSED NORTH NASHUA TERRACE DOWN A DRAINAGE DITCH THROUGH A WOODED AREA AND THROUGH THE BACK AND SIDE YARDS OF TWO HOMES LOCATED ON EAST MONOPOLY LOOP, SOUTH ON MONOPOLY LOOP, LEFT ONTO NORTH LAFAYETTE WAY THEN EAST ONTO EAST HAMPSHIRE STREET THEN SOUTH ONTO A SMALL EASEMENT. I CONTINUED TO FOLLOW THE VEHICLE AS IT CRASHED THROUGH A BARBED WIRE FENCE ONTO THE PROPERTY AT 2228 EAST HAMPSHIRE STREET. THE VEHICLE THEN TURNED EAST ONTO THE PROPERTY DRAGGING THE FENCE, CRASHED THROUGH A SECOND WOOD-SLAT AND BARBED WIRE FENCE. THE VEHICLE THEN DROVE AROUND THE PROPERTY ONTO THE DRIVEWAY TOWARDS THE FRONT GATE. WHEN DRIVER REALIZED THE GATE WAS CLOSED, HE TURNED EAST BETWEEN TWO HORSE CORRALS, CRASHED THROUGH FENCE ANOTHER ON THE EAST SIDE OF THE PROPERTY AND INTO A TREE WHERE HE CAME TO A STOP. THE DRIVER EXITED THE VEHICLE AT THE SAME TIME I EXITED MY PATROL VEHICLE. I ORDERED THE SUSPECT/DEFENDANT (MR WILLIAM HADDEN) TO STOP; HOWEVER, HE REFUSED AND RAN EAST THROUGH WOODS INTO THE BACKYARD OF A RESIDENCE LOCATED AT 2234 EAST HAMPSHIRE STREET WHERE DEPUTY HAYNES CAUGHT UP WITH HIM AND WE WERE ABLE TO TAKE HIM INTO CUSTODY. I ASKED THE DEFENDANT WHY HE HAD RAN, TO WHICH HE ADVISED HE HAD WARRANTS AND THAT HE WAS A HABITUAL OFFENDER ON DRIVING WHILE HIS LICENSE WAS SUSPENDED/REVOKED. THE DEFENDANT WAS THEN PLACED IN THE BACK SEAT OF DEPUTY RAMOS' PATROL VEHICLE WHERE HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. HIS BOND WAS SET AT A TOTAL OF $12,250.00, FOR ALL CHARGES, PER THE BOND SCHEDULE. THE DEFENDANT WAS WRITTEN A UNIFORM TRAFFIC CITATION (UTC) NUMBER 1002-FIR FOR THE ORIGINAL PURPOSE OF THE STOP, FOR SPEEDING, 42 MPH IN 30 MPH POSTED SPEED ZONE. HE WAS ISSUED CITATION NUMBER 1003-FIR FOR FLEEING AND ELUDING A POLICE OFFICER, CITATION NUMBER 1004-FIR, FOR DRIVING WHILE LICENSE SUSPENDED/REVOKED HABITUAL OFFENDER AND CITATION NUMBER 1005-FIR FOR RECKLESS DRIVING, WITH PROPERTY DAMAGE. THE DEFENDANT'S VEHICLE WAS TOWED BY HOLMAN'S TOWING AND STORED AT THEIR IMPOUND LOT. THE TOTAL PROPERTY DAMAGE WAS ESTIMATED AT APPROXIMATELY $1400.00. *NOT-EXEMPT* |
