SUBMITTED BY: HORTON, TIMOTHY 0614 (AR10116482) DID THEN AND THERE UNLAWFULLY AND KNOWINGLY UTTER AND PUBLISH AS TRUE CERTAIN FALSE, ALTERED OR FORGED WRITTEN UNIFORM TRAFFIC CITATION, TO THE VICTIM, TO WIT: THREE UNIFORM TRAFFIC CITATION (2089RPA3, 2090RPA7, 2091RPA8), KNOWING FULL WELL THAT SAID WRITTEN UNIFORM TRAFFIC CITATION WERE FALSE, ALTERED OR FORGED, SAID UNIFORM TRAFFIC CITATION BEING PASSED WITH THE INTENT THEN AND THERE TO INJURE AND DEFRAUD THE VICTIM, AND DIVERSE OTHER PERSONS TO THE STATE ATTORNEY UNKNOWN, IN VIOLATION OF FLORIDA'S STATE STATUTE 831.02. IT IS UNLAWFUL FOR A PERSON WHO HAS BEEN ARRESTED OR LAWFULLY DETAINED BY A LAW ENFORCEMENT OFFICER TO GIVE A FALSE NAME, OR OTHERWISE FALSELY IDENTIFY HIMSELF OR HERSELF IN ANY WAY, TO THE LAW ENFORCEMENT OFFICER OR ANY COUNTY JAIL PERSONNEL, IN VIOLATION OF FLORIDA'S STATE STATUTE NUMBER 901.36(2). DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA'S STATE STATUTE 322.34(2)(A). DID KNOWINGLY ATTACH TO ANY MOTOR VEHICLE OR MOBILE HOME ANY REGISTRATION LICENSE PLATE, OR WHO KNOWINGLY ATTACHES ANY VALIDATION STICKER OR MOBILE HOME STICKER TO A REGISTRATION LICENSE PLATE, WHICH PLATE OR STICKER WAS NOT ISSUED AND ASSIGNED OR LAWFULLY TRANSFERRED TO SUCH VEHICLE, IS IN VIOLATION OF FLORIDA'S STATE STATUTE 320.261 ON 082410 AT APPROXIMATELY 1614 HOURS, I WAS ADVISED BY DEPUTY B VICK THAT WHILE HE WAS IN A WOODED AREA LOCATED AT 5520 WEST GROVER CLEVELAND BOULEVARD IN HOMOSASSA, HE HAD LOCATED A 1991 WHITE CHEVY PICKUP TRUCK BEARING VEHICLE IDENTIFICATION NUMBER 1GCDC14Z7MZ175838 IN A WOODED AREA LOCATED DOWN A DIRT PATH ON THE SOUTH SIDE OF THE RESIDENCE. HE ADVISED THAT THIS VEHICLE MATCHED THE SAME VEHICLE WHICH THIS DEPUTY HAD STOPPED DURING A TRAFFIC STOP ON 072710 AT APPROXIMATELY 2036 HOURS, ON US HIGHWAY 19 AND WEST HALLS RIVER ROAD. IT WAS REPORTED ON 081110 THAT THE DRIVER, WHICH I HAD STOPPED, GAVE FALSE INFORMATION AND GAVE THE NAME OF THE VICTIM WITH A DATE OF BIRTH OF 082565. THIS DEPUTY HAD STOPPED THE VEHICLE FOR HAVING ATTACHED TAG NOT ASSIGNED (TAG NUMBER C782IC) WHICH CAME BACK TO A TAG REGISTERED TO A TRAILER AND THE DRIVER WAS NOT WEARING HIS SEATBELT. IT WAS ALSO DISCOVERED THAT THE DRIVER DID NOT DISPLAY HIS DRIVER'S LICENSE ON DEMAND. WITH THIS INFORMATION RECEIVED, I CHECKED THE NAME IN THE DRIVER AND VEHICLE IDENTIFICATION DATA BASE AND OBSERVED A PHOTOGRAPH THAT APPEARED TO BE THE SUBJECT. EVERYTHING APPEARED TO CHECK OUT WITH THE DRIVER AND VEHICLE IDENTIFICATION DATA BASE PHOTOGRAPH AND THE INFORMATION I RECEIVED. THE SUBJECT WAS ISSUED THREE UNIFORM TRAFFIC CITATIONS (2089RPA3, 2090RPA7, 2091RPA8). THE FIRST CITATION 2089RPA3 WAS FOR SAFETY BELT VIOLATION WITH A TRAFFIC FINE OF $116.00. THE SECOND CITATION 2090RPA7 WAS FOR ATTACHING LICENSE PLATE NOT ASSIGNED TO THE VEHICLE WITH A MANDATORY COURT APPEARANCE OF 081210 AT 1300 HOURS. THE THIRD CITATION 2091RPA8 WAS FOR FAILURE TO EXHIBIT DRIVER'S LICENSE ON DEMAND WITH A TRAFFIC FINE OF $113.00. AFTER THE SUBJECT SIGNED THE CITATIONS, HE PROVIDED ME WITH A FINGERPRINT. INFORMATION WAS ALSO RECEIVED THAT ON 081110, THE VICTIM, WHO'S NAME WAS FORGED/USED ON THE CITATIONS, HAD GONE TO THE CRYSTAL RIVER SUBSTATION WHERE A FINGERPRINT ANALYSIS WAS COMPLETED. HE STATED THAT HE RECEIVED COURT PAPERWORK TO APPEAR IN COURT TO ANSWER THE CHARGES REGARDING THE TRAFFIC STOP. THE VICTIM ADVISED THAT HE WAS UNAWARE OF THE STOP AND THAT THE SIGNATURE ON THE CITATIONS WERE NOT HIS. WHILE AT 5520 WEST GROVER CLEVELAND, I MADE CONTACT WITH A WHITE FEMALE SUBJECT AT THE RESIDENCE WHO WAS ADVISED AND ASKED IF SHE KNEW THE OWNER OF THE WHITE PICKUP TRUCK LOCATED IN THE WOODED AREA LOCATED BEHIND HER RESIDENCE. SHE WAS ALSO ASKED IF SHE KNEW THE SUBJECT. TO WHICH SHE SAID NO TO BOTH QUESTIONS. SHE ALSO ADVISED ME THAT HER BOYFRIEND WAS THE VICTIM. WE THEN ASKED HER IF WE COULD LOOK INSIDE THE RESIDENCE, TO WHICH SHE ALLOWED DEPUTY VICK AND I TO ENTER AND CHECK THE RESIDENCE FOR THE SUBJECT. WHILE STANDING IN THE DOORWAY, WE WERE TOLD THERE WAS A SUBJECT INSIDE THE RESIDENCE, AT WHICH TIME, THE SUBJECT CAME OUT OF THE BACK BEDROOM AND ADVISED US THAT HE WAS THE ONE WE WERE LOOKING FOR. UPON OBSERVING THE SUBJECT, I IMMEDIATELY IDENTIFIED HIM TO BE THE SAME SUBJECT WHO WAS THE DRIVER ON THE TRAFFIC STOP ON 072710 AND THE SAME PERSON WHO HAD SIGNED ALL THREE TRAFFIC CITATIONS. THE SUBJECT THEN IDENTIFIED HIMSELF AS MR WILLIAM HENDRIX. THE SUSPECT WAS READ HIS MIRANDA WARNINGS PER PREPRINTED AGENCY CARD. THE SUSPECT ADVISED HE UNDERSTOOD HIS RIGHTS AND WANTED TO TALK TO ME. HE ADVISED THAT HE SIGNED THE CITATIONS USING HIS FRIEND'S NAME AND IN DOING SO, STATED HE WAS AFRAID OF GETTING IN TROUBLE BECAUSE HE HAD A SUSPENDED DRIVER'S LICENSE AND THAT HE HAD A WARRANT AND HE KNEW HE WAS GOING TO BE ARRESTED. THE SUBJECT WAS PLACED UNDER ARREST, HANDCUFFED, BEHIND HIS BACK, (DOUBLE LOCKED), SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. AT THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT WAS ISSUED A UNIFORM TRAFFIC CITATION NUMBER 7797FRY9 FOR DRIVING WHILE LICENSE SUSPENDED KNOWINGLY AS OF 120709 FOR FAILURE TO PAY TRAFFIC FINES WITH A MANDATORY COURT APPEARANCE AT THE CITRUS COUNTY COURTHOUSE ON 091610 AT 1300 HOURS. THE DEFENDANT WAS ALSO RE-ISSUED THE FIRST UNIFORM TRAFFIC CITATION 7798FRYX FOR ATTACHING TAG NOT ASSIGNED WITH A FINE OF $150.00. THE SECOND UNIFORM TRAFFIC CITATION ISSUED WAS 7799FRYX FOR SEAT BELT VIOLATION WITH A $116.00 FINE. THE THIRD UNIFORM TRAFFIC CITATION ISSUED WAS 7800FRY9 FOR FAILURE TO EXHIBIT DRIVER'S LICENSE UPON DEMAND WITH A FINE OF $113.00. THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $5,650.00, PER THE BOND SCHEDULE. AFTER I LEFT THE SCENE, DEPUTY VICK HAD THE VEHICLE TOWED BY DAVE'S AUTO.
