\tSUBMITTED BY: POLLARD, RANDALL 0677 (AR14- 9788) ANY PERSON WHO KNOWINGLY SELLS, PURCHASES, MANUFACTURES, DELIVERS OR BRINGS INTO THIS STATE OR WHO IS KNOWINGLY IN ACTUAL OR CONSTRUCTIVE POSSESSION OF 200 GRAMS OR MORE OF METHAMPHETAMINE IS GUILTY OF A FELONY OF THE FIRST DEGREE, WHICH FELONY SHALL BE KNOWN AS TRAFFICKING IN METHAMPHETAMINE, AND SUCH PERSON SHALL BE SENTENCED TO A MANDATORY MINIMUM OF 15 YEARS, IN VIOLATION OF FLORIDA STATE STATUTE 893.135(1)(F).\t \t WHOEVER COMMITS ANY CRIMINAL OFFENSE AGAINST THE STATE, WHETHER FELONY OR MISDEMEANOR, OR AIDS, ABETS, COUNSELS, HIRES, OR OTHERWISE PROCURES SUCH OFFENSE TO BE COMMITTED, AND SUCH OFFENSE IS COMMITTED OR IS ATTEMPTED TO BE COMMITTED, IS A PRINCIPAL IN THE FIRST DEGREE AND MAY BE CHARGED, CONVICTED, AND PUNISHED AS SUCH, WHETHER HE OR SHE IS OR IS NOT ACTUALLY OR CONSTRUCTIVELY PRESENT AT THE COMMISSION OF SUCH OFFENSE, IN VIOLATION OF FLORIDA STATE STATUTE 777.011 DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 040414, WHILE CONDUCTING TRAFFIC ENFORCEMENT ON EAST GULF TO LAKE HIGHWAY IN INVERNESS, I WAS INFORMED BY SERGEANT MARSHALL THAT A GRAY MITSUBISHI ECLIPSE WAS TRAVELING AT A HIGH RATE OF SPEED WEST BOUND ON EAST GULF TO LAKE HIGHWAY. SERGEANT MARSHALL ADVISED HE PACED THE VEHICLE IN HIS UNMARKED UNIT AT 72 MILES PER HOUR (MPH) IN A 60 MPH ZONE. HE ALSO ADVISED ME HE WAS COMING UP TO THE AREA OF LITTLE JOHN ROAD. AT THAT TIME, I WAS IN MY MARKED PATROL UNIT TURNING WEST BOUND ON EAST GULF TO LAKE HIGHWAY FROM LITTLE JOHN ROAD. I TURNED APPROXIMATELY 200 YARDS BEHIND THE VEHICLE AND FOLLOWED THEM WEST BOUND. AFTER CATCHING UP TO THE VEHICLE, I PACED IT FOR APPROXIMATELY THREE QUARTERS OF A MILE WITH MY CALIBRATED SPEEDOMETER AT 70 MPH IN A 60 MPH ZONE. AT THAT TIME, I RELAYED TO DEPUTY CROSNOE, WHO WAS IN THE AREA OF GOSPEL ISLAND ROAD, TO CONDUCT A TRAFFIC STOP ON THE VEHICLE. DEPUTY CROSNOE THEN PULLED OUT IN FRONT OF THIS DEPUTY AND CONDUCTED A TRAFFIC STOP AT 8929 EAST GULF TO LAKE HIGHWAY. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, HE PROVIDED HIS FLORIDA DRIVER'S LICENSE TO DEPUTY CROSNOE AND WAS THEN IDENTIFIED AS MR WILLIAM LUCAS. HE DID ADVISE THERE WERE TWO SEMI AUTOMATIC PISTOLS IN THE CENTER CONSOLE OF THE VEHICLE. AT THAT TIME, DEPUTY CROSNOE REMOVED THE GUNS AND I REQUESTED K-9 DEPUTY BEHNEN TO RESPOND TO MY LOCATION TO CONDUCT AN EXTERIOR SNIFF OF THE VEHICLE. DEPUTY BEHNEN ARRIVED ON SCENE AND ADVISED ME HIS K-9 DID ALERT TO THE VEHICLE, AT WHICH TIME I REQUESTED THE PASSENGER AND DRIVER TO EXIT THE VEHICLE. ALL SUBJECTS WERE PATTED DOWN ON THE EXTERIOR OF THEIR CLOTHING FOR WEAPONS. NO FURTHER WEAPONS WERE LOCATED. A SEARCH OF THE VEHICLE YIELDED A BLACK AND SILVER BOX WHICH WAS LOCATED IN THE REAR DRIVER SEAT. UPON OPENING THE BOX, A CRYSTAL LIKE SUBSTANCE WAS LOCATED INSIDE AND RECOGNIZED THROUGH MY TRAINING AND EXPERIENCE TO BE METHAMPHETAMINE. ALSO LOCATED IN THE BOX WERE SEVERAL DOZEN SYRINGES, DOZENS OF SMALL CLEAR PLASTIC BAGGIES, A SCALE, AND A SPOON. A PRESUMPTIVE FELID TEST OF THE CRYSTAL LIKE SUBSTANCE DID YIELD POSITIVE FOR METHAMPHETAMINE. THE METHAMPHETAMINE WAS WEIGHED AT APPROXIMATELY 27.81 GRAMS. AT THAT TIME, I READ WILLIAM HIS MIRANDA WARNINGS VIA AN AGENCY PRE PRINTED CARD. MR LUCAS STATED THE METHAMPHETAMINE WAS HIS. I THEN READ THE REAR PASSENGER/DEFENDANT, MS TANYA LUCAS, WHO WAS SITTING NEXT TO THE BLACK AND SILVER BOX, HER MIRANDA WARNINGS VIA AN AGENCY PRE PRINTED CARD. SHE STATED SHE DID UNDERSTAND AND WHISHED TO SPEAK WITH ME. SHE DID ADMIT TO TAKING $1,500.00 FROM HER AND WILLIAMâS BANK ACCOUNT IN PENSACOLA AND DROVE HERE TO PURCHASE METHAMPHETAMINE AND TO ALSO SEE THEIR SON IN ORLANDO. TANYA ALSO STATED THE NARCOTICS BELONGED TO HER AND WILLIAM. AT THAT TIME, WILLIAM AND TANYA WERE PLACED UNDER ARREST AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. WHILE AT THE CITRUS COUNTY DETENTION FACILITY, I CONDUCTED RECORDED POST MIRANDA INTERVIEWS WITH BOTH TANYA AND WILLIAM. THEY BOTH CONFESSED TO WITHDRAWING MONEY FROM REGIONS BANK IN PENSACOLA TO PURCHASE THE METHAMPHETAMINE. THEY BOTH STATED THE METHAMPHETAMINE WAS THEIRS AND IS USUALLY A SIX MONTH SUPPLY FOR PERSONAL USE. THEY BOTH ADMITTED TO BEING OCCASIONAL USERS AND STATED THEY BOUGHT THE DOPE FROM DOWN SOUTH IN DADE CITY. THE METHAMPHETAMINE THAT WAS SEIZED ALONG WITH THE BOX, GUNS, AND NUMEROUS AMOUNTS OF DRUG PARAPHERNALIA WILL BE PLACED INTO EVIDENCE AT THE EMERGENCY OPERATIONS CENTER. THE VEHICLE THAT THE DEFENDANT WAS DRIVING WAS REGISTERED TO HIM AND TANYA. FORFEITURE FORMS WERE COMPLETED AND SIGNED BY BOTH PARTIES. COPIES OF THE FORFEITURE FORMS WILL BE PLACED INTO THEIR PROPERTY AT THE CITRUS COUNTY DETENTION FACILITY. A WRITTEN TRAFFIC WARNING WAS COMPLETED BY DEPUTY CROSNOE ON SCENE FOR SPEEDING. PHOTOGRAPHS WERE TAKEN ON SCENE BY DEPUTY CROSNOE OF THE VEHICLE, NARCOTICS, GUNS, AND DRUG PARAPHERNALIA IN THE VEHICLE ALONG WITH THE LOCATIONS OF WHERE THE ITEMS WERE PLACED IN THE VEHICLE. COPIES OF THOSE PHOTOGRAPHS WILL ALSO BE TURNED INTO RECORDS. BOTH DEFENDANTS BONDS WERE SET AT $51,500.00, PER THE BOND SCHEDULE. \t \tNO FURTHER ACTION BY THIS DEPUTY. |
