Probable cause affidavit: SUBMITTED BY: TABB, LYNN 0418 (AR08105364) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: SWEETBAY, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: MEAT, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). ON 092308 AT APPROXIMATELY 1752 HOURS, I WAS DISPATCHED TO THE SWEETBAY STORE IN CRYSTAL RIVER IN REFERENCE TO A THEFT IN PROGRESS. WHILE EN ROUTE, I WAS ADVISED THAT THE DEFENDANT HAD TAKEN MEAT WITHOUT PAYING FOR IT AND WAS LEAVING THE AREA IN A FOUR DOOR OLDSMOBILE WITH A FLORIDA TAG OF I679WF. THE VEHICLE WAS LAST SEEN HEADING NORTH BOUND ON SE 8TH AVENUE. I PLACED A "BOLO" FOR THE VEHICLE WITH UNITS AND RESPONDED TO THE STORE. UPON MY ARRIVAL, I MADE CONTACT WITH TWO MANAGERS WHO STATED THAT THIS WAS THE SAME INDIVIDUAL WHO HAD STOLEN FROM THEM IN A PRIOR CASE. THEY STATED THAT THE DEFENDANT ENTERED THE STORE, PICKED UP A HAND HELD BASKET, WENT TO THE MEAT CASE AND FILLED IT UP, AND THEN WALKED OUT OF THE STORE WITHOUT PAYING FOR IT. BOTH MANAGERS/WITNESS ONE AND TWO FOLLOWED THE DEFENDANT TO HIS VEHICLE. THEY OBSERVED THE BASKET FULL OF MEAT. THEY STATED THE DEFENDANT GOT INTO HIS VEHICLE AND RACED OUT OF THE PARKING LOT. WITNESS ONE WAS ABLE TO OBTAIN THE TAG NUMBER ON THE VEHICLE WHICH HE GAVE THIS DEPUTY. WITNESS ONE SHOWED ME THE SURVEILLANCE TAPE OF THE STORE. I OBSERVED THE DEFENDANT ENTERING THE STORE THROUGH THE EAST DOOR WAY AT 1745 HOURS. I OBSERVED THE DEFENDANT'S FACE ON THE SURVEILLANCE TAPE. I OBSERVED HIM PICK UP A HAND HELD BASKET AT THE DOORWAY AND ENTER THE STORE. AROUND 1748 HOURS THE DEFENDANT WAS OBSERVED ON THE TAPE LEAVING THROUGH THE EAST DOOR CARRYING A BASKET FULL OF MEAT. THE DEFENDANT WAS WEARING A LONG SLEEVE BLACK TEE SHIRT. BOTH WITNESS ONE AND TWO COMPLETED WRITTEN STATEMENTS WHICH WERE LATER TURNED IN TO RECORDS AT THE SHERIFF'S OFFICE. WITNESS ONE STATED THAT HE WOULD BE ABLE TO BURN A COPY OF THE SURVEILLANCE TAPE AND WOULD CALL WHEN IT WAS COMPLETED. WITNESS ONE AND TWO STATED THAT THE BASKET WAS FULL OF MEAT AND ESTIMATED THE VALUE OF THE STOLEN PROPERTY AT $300 TO $400. I ISSUED WITNESS ONE A CASE CARD. I WAS THEN ADVISED THAT DEPUTY FARMER WAS WITH THE DEFENDANT AT 6409 WEST CHERRYWOOD STREET. WITNESS TWO AGREED TO GO AND IDENTIFY THE DEFENDANT. SERGEANT GRANT TRANSPORTED WITNESS TWO TO THE LOCATION. AT 1905 HOURS, WITNESS TWO POSITIVELY IDENTIFIED THE DEFENDANT AS THE SUBJECT WHO LEFT THE STORE WITHOUT PAYING FOR THE MEAT. WHILE EN ROUTE TO THE ADDRESS ON CHERRYWOOD STREET, I OBSERVED A BLACK LONG SLEEVE TEE SHIRT LAYING IN THE MIDDLE OF THE ROADWAY AT NE 8TH AVENUE NEAR THE INTERSECTION OF NE 1ST TERRACE. THIS WAS THE ESCAPE ROUTE THAT THE DEFENDANT DROVE WHILE LEAVING THE STORE. I RECOVERED THE TEE SHIRT FROM THE ROADWAY AND PROCEEDED ON TO CHERRYWOOD STREET. AT THAT TIME, I MADE CONTACT WITH THE DEFENDANT. I READ THE DEFENDANT HIS MIRANDA WARNINGS VIA CARD. THE DEFENDANT STATED HE UNDERSTOOD HIS RIGHTS AND WAS WILLING TO ANSWER QUESTIONS OF THIS DEPUTY. THE DEFENDANT STATED THAT HE DID ENTER THE SWEETBAY STORE AND FILLED UP A HAND HELD CARRY BASKET FULL OF MEAT AND THEN LEFT THE STORE WITHOUT PAYING FOR IT. THE DEFENDANT STATED THAT HE FILLED THE BASKET FULL OF STEAKS AND OTHER EXPENSIVE MEATS. THE DEFENDANT STATED THAT HE HAD ALREADY TRADED THE MEAT FOR CRACK COCAINE. THE DEFENDANT STATED HE HAD ALREADY USED THE CRACK COCAINE AND HAD NO IDEA WHERE THE MEAT WAS AT THIS TIME. THE DEFENDANT STATED THAT THIS WAS NOT HIS FIRST TIME DOING THIS AND CONFESSED TO SEVERAL OTHER THEFTS IN THE AREA. THE DEFENDANT POSITIVELY IDENTIFIED THE BLACK TEE SHIRT AS BEING HIS. HE STATED THAT WHILE DRIVING DOWN THE ROAD FROM SWEETBAY HE TOOK IT OFF AND THREW IT OUT THE WINDOW. I THEN ARRESTED THE DEFENDANT, PLACED HIM IN DOUBLE LOCKED HANDCUFFS, PLACED HIM IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY. *NOT-EXEMPT*
