SUBMITTED By: FARKAS, STEVEN 0408 (AR11118784) did unlawfully traffic in or endeavor to traffic in property that HE knew or should have known was stolen, to-wit: ONE PAIR OF GOLD HOOP EARRINGS, the property of THE VICTIM, in violation of Florida Statute 812.019(1); DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: ONE PAIR OF GOLD HOOP EARRINGS OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). KNOWINGLY GAVE FALSE VERIFICATION OF OWNERSHIP OF A PAIR OF GOLD HOOP EARRINGS, WHO RECEIVED MONEY IN THE AMOUNT OF $75.00 FROM THE PAWNBROKER FOR THE GOLD HOOP EARRINGS VALUED AT LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 539.001(8)(B)(8)(A). ON 011011 IT WAS REPORTED BY THE VICTIM, MS SANDRA GREENE, THE THEFT OF JEWELRY FROM INSIDE HER RESIDENCE LOCATED AT 19 VIBURNUM COURT IN HOMOSASSA. THE VICTIM REPORTED THAT THE THEFT OCCURRED BETWEEN 050110 AND 011011. ON 011211, FURTHER INVESTIGATION BY THIS DETECTIVE REVEALED THAT THE DEFENDANT, MR WILLIAM STRMISKA, HAD SOLD THE VICTIM'S GOLD HOOP EARRINGS, VALUED AT $600.00, TO NEAL'S PAWN SHOP IN HOMOSASSA ON 051710 AT 1031 HOURS, WHERE HE RECEIVED $175.00 FOR THE STOLEN EARRINGS AND A PAIR OF BANGLE BRACELETS. THE DEFENDANT DID PRODUCE HIS FLORIDA DRIVER'S LICENSE WITH HIS PHOTOGRAPH AND DID PLACE HIS RIGHT THUMB PRINT ON THE LOWER RIGHT PORTION OF THE FLORIDA PAWNBROKER TRANSACTION FORM, NUMBER Q19815, AND DID SIGN SAID FORM PLEDGING THAT THE EARRINGS WERE NOT STOLEN AND THAT HE WAS THE RIGHTFUL OWNER OF THE PROPERTY AND DID HAVE THE RIGHT TO SELL THE EARRINGS. ON 011211 THE VICTIM DID MEET THIS DETECTIVE AT NEAL'S PAWN SHOP, WHERE SHE POSITIVELY IDENTIFIED THE EARRINGS AS THE ONES STOLEN FROM HER AND REPORTED TO THIS AGENCY ON 011011. THE VICTIM ALSO PROVIDED ME WITH A SWORN WRITTEN STATEMENT THAT IN OCTOBER OF 2009, SHE HIRED A LOCAL CONTRACTOR TO PERFORM PAINTING AND NECESSARY REPAIRS TO HER HOME AT 19 VIBURNUM COURT IN HOMOSASSA. THE DEFENDANT WAS PART OF THE CONTRACTOR'S CREW AND SHE KNEW THE DEFENDANT AT THAT TIME AS "BILLY". THE VICTIM WENT ON TO STATE THAT ON 010511 HER NEIGHBOR AT 17 VIBURNUM COURT INFORMED HER THAT THE DEFENDANT WAS ARRESTED FOR BURGLARIZING HER RESIDENCE AT 17 VIBURNUM COURT. THE VICTIM THEN GOOGLED THE DEFENDANT'S NAME AND THE DEFENDANT'S PHOTOGRAPH APPEARED ON AN INTERNET WEBSITE. THE VICTIM THEN REALIZED THAT THE DEFENDANT WAS THE SAME INDIVIDUAL KNOWN AS BILLY WHO PAINTED HER HOME. THE VICTIM THEN CONTACTED THIS AGENCY. ON 011211, CONTACT WAS MADE WITH THE DEFENDANT AT THE CITRUS COUNTY DETENTION FACILITY, WHERE HE IS CURRENTLY INCARCERATED ON UNRELATED CHARGES. THE DEFENDANT WAS THEN INFORMED OF HIS NEW CHARGES. UPON HEARING OF THE ALLEGATIONS AGAINST HIM, THE DEFENDANT MADE A STATEMENT TO THIS DETECTIVE, PRE MIRANDA, THAT "THEY (EARRINGS) WERE JUST LYING THERE AND I TOOK THEM". THE DEFENDANT WAS THEN STOPPED FROM SPEAKING AND READ MIRANDA VIA PRE-PRINTED CARD. THE DEFENDANT STATED THAT HE UNDERSTOOD HIS RIGHTS; HOWEVER HE DECLINED TO FURTHER SPEAK WITH ME. THE DEFENDANT'S BOND IS TO BE SET AT $9,000.00 PER THE BOND SCHEDULE.
