SUBMITTED BY: ventimiglia, lisa 0621 (ar14-10725) (case 14-79300) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 061014 I WAS TRAVELING SOUTHBOUND ON NORTH U S HIGHWAY 41 WHEN I OBSERVED A SINGLE VEHICLE TRAVELING NORTHBOUND AT A HIGH RATE OF SPEED. I VISUALLY ESTIMATED THE VEHIcLE TRAVELING 60 Miles per hour (mph) AND I THEN ACTIVATED MY RADAR UNIT AND RECEIVED A CLEAR DOPPLER TONE OF 60 MILES PER HOUR. I THEN TURNED AROUND AND ACTIVATED MY EMERGeNCY LIGHTS AND INITIATED A TRAFFIC STOP. THE DRIVER EXITED THE VEHICLE, PUTTING HIS HEAD DOWN AND SPONTANEOUSLY UTTERING, âMY LICENSE IS SUSPENDEDâ. HE HAD A PASSENGER, MR WILLIAM CHRISTOPHER YATES, JR., WHO I ASKED TO STEP OUT OF THE VEHICLE. I ASKED BOTH FOR THEIR IDENTIFICATION. WHEN BILLY, jr., RETRIEVED HIS LICENSE FROM HIS POCKET A METAL PIPE FELL TO THE GROUND, TO WHICH MR YATES STATED, âTHATâS MINEâ. I ASKED MR YATES WHY HIS SON BILLY WAS NOT DRIVING AND HE STATED THAT HIS LICENSE WAS ALSO SUSPENDED. I REQUESTED BACKUP AND DEPUTY MACIAs, id: 0756 arrived. while waiting for backup i observed billy continuously reaching toward the center of his pants. i advised deputy macias that i believed billy was concealing something in the front of his pants. billy gave verbal consent to a pat down and disclosed he was concealing a pill bottle containing marijuana in the front of his pants, which he handed to deputy macias. mr yates then said, âthatâs also mineâ. billy, jr., was placed into custody, handcuffed, DOUBLE LOCKED and placed in the rear seat of my patrol vehicle. mr yates gave a verbal consent to a pat down and he was then placed in custody, handcuffed, double locked and placed in the back seat of deputy maciasâs patrol vehicle. per teletype operator 0718, mr yatesâ driverâs license is currently suspended for non judgment, and his criminal history shows conviction for dui on 10/04/91 by POMPANO beach police department. per citrus county sheriffâs office aegis, on 051813 in case 2013-65486 i issued mr yates a citation for driving while his license was suspended/revoked and attached tag not assigned. on 061014 mr yates was issued citation number 8145hbh-3 for dwlsr and he was transported without incident to citrus county detention facility where he was turned over to staff for booking and processing. the defendantâs son billy, jr., was issued a notice to appear citation for possession of under 20 grams of marijuana, per florida state statute 893.13, notice to appear citation number 18936 WITH a mandatory court date of 070314 at 1300 hours. he was released. defendant yates gave billy, jr. his personal possessions and advised his son to call a friend to remove the vehicle. per department of highway safety and motor vehicles, mr yatesâ florida tag 889yvr, was seized and placed into evidence. the .06 grams of marijuana and the metal pipe collected from billy, jr. were also collected and turned over to evidence. |
