SUBMITTED BY: SLINGERLAND, DANIEL 0443 (AR12124609) DID HAVE A SEXUALLY TRANSMISSIBLE DISEASE, TO WIT: HUMAN IMMUNODEFICIENCY VIRUS INFECTION (HIV), AND THE DEFENDANT DID KNOW THAT SHE WAS INFECTED WITH THIS DISEASE, AND HAD BEEN INFORMED THAT SHE MAY COMMUNICATE THIS DISEASE TO ANOTHER PERSON THROUGH SEXUAL INTERCOURSE, DID HAVE SEXUAL INTERCOURSE WITH MULTIPLE VICTIMS WITHOUT INFORMING THEM FIRST OF THE PRESENCE OF THE SEXUALLY TRANSMISSIBLE DISEASE (HIV), THUS COMMITTING A FELONY OF THE FIRST DEGREE, IN VIOLATION OF FLORIDA STATE STATUTE 384.24(2). ON 123011, THIS AGENCY BECAME INVOLVED IN A SEX OFFENSE CASE WITH THE NATURE OF THE ALLEGATIONS BEING THAT THE DEFENDANT, MS YVONNE NICOLE ANDREWS, WAS IN FACT, INFECTED WITH THE HUMAN IMMUNODEFICIENCY VIRUS (HIV) AND HAD BEEN HAVING SEXUAL INTERCOURSE WITH MULTIPLE MALE VICTIMS AND NOT DISCLOSING TO THEM THAT SHE WAS HIV POSITIVE. THE DEFENDANT IS CURRENTLY OUT ON BOND REFERENCE AN ARREST IN MARCH OF 2011 FOR THE EXACT SAME CHARGE. THROUGH THE COURSE OF THIS INVESTIGATION, CONTACT WAS MADE WITH TWO VICTIMS WHO BOTH PROVIDED THE CITRUS COUNTY SHERIFF'S OFFICE WITH SWORN STATEMENTS ADVISING THAT THEY HAD SEXUAL INTERCOURSE WITH THE VICTIM AND THAT SHE DID NOT DISCLOSE TO THEM THAT SHE WAS INFECTED WITH HIV. THE FIRST VICTIM ADVISED THAT HE AND THE DEFENDANT DID HAVE SEXUAL INTERCOURSE TWO TIMES, BETWEEN 122511 AND 122611 AT THE DEFENDANT'S RESIDENCE LOCATED AT 9490 SOUTH CLEARSPRINGS DRIVE IN FLORAL CITY AND THAT THE SEXUAL INTERCOURSE WAS UNPROTECTED. THE SECOND VICTIM STATED THAT HE DID HAVE SEXUAL INTERCOURSE WITH THE DEFENDANT ON TWO OCCASIONS IN CITRUS COUNTY NEAR THE GOBBLER MUD HOLE IN FLORAL CITY, INSIDE THE DEFENDANT'S VEHICLE. EACH SEXUAL ENCOUNTER WAS UNPROTECTED, AND INCIDENTS TOOK PLACE ON TWO CONSECUTIVE WEEKENDS WITH THE FIRST INCIDENT TAKING PLACE ON OR ABOUT 121711 AND THE SECOND INCIDENT ON 122511; THE SAME DAY AS VICTIM NUMBER ONE. iN THE PRIOR CASE INVOLVING THE DEFENDANT IN MARCH OF 2011, THE DEFENDANT DID ADMIT THAT SHE WAS, IN FACT, INFECTED WITH HIV AND HAS KNOWN ABOUT HER MEDICAL STATUS SINCE DECEMBER OF 2008. SHE ALSO ADVISED THAT THE HEALTH DEPARTMENT COUNSELED HER WHEN SHE WAS DIAGNOSED THAT SHE MAY COMMUNICATE THIS DISEASE TO ANOTHER PERSON THROUGH SEXUAL INTERCOURSE AND THAT IT WAS A CRIMINAL OFFENSE TO HAVE SEXUAL INTERCOURSE WITH ANY OTHER PERSON WITHOUT FIRST INFORMING THEM OF THE PRESENCE OF THE SEXUALLY TRANSMISSIBLE DISEASE (HIV). ON 013112, AT 1730 HOURS, I received AN INTERAGENCY EMAIL FROM DETECTIVE BALL ADVISING THAT HE HAD PROBABLE CAUSE FOR THE ARREST OF THE DEFENDANT. AT 1815 HOURS, I RESPONDED TO 9490 SOUTH CLEARSPRINGS DRIVE IN FLORAL CITY, WHERE I MADE CONTACT WITH THE DEFENDANT. I ADVISED THE DEFENDANT THAT I NEEDED TO SPEAK WITH HER TO WHICH SHE STATED SHE HAD CONTACTED HER LAWYER AND THAT SHE DID NOT WANT TO SPEAK WITH ME. THE DEFENDANT WAS PLACED UNDER ARREST AND CHARGED WITH TWO COUNTS OF HAVing SEXUAL INTERCOURSE WITH MULTIPLE VICTIMS WITHOUT INFORMING THEM FIRST OF THE PRESENCE OF THE SEXUALLY TRANSMISSIBLE DISEASE (HIV). THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE THE DEFENDANT'S BOND WAS SET AT $20,000.00 PER THE BOND SCHEDULE.
