SUBMITTED BY: SUNDBERG, KURT 1268 (AR14-12363) DID OPERATE A VEHICLE IN THE STATE OF FLORIDA AND, HAVING KNOWLEDGE THAT HE HAD BEEN DIRECTED TO STOP SUCH VEHICLE BY A DULY AUTHORIZED LAW ENFORCEMENT OFFICER, WITH AGENCY INSIGNIA AND LIGHTS WITH SIRENS, AND DID WILLFULLY REFUSE OR FAIL TO STOP SUCH VEHICLE IN COMPLIANCE WITH SUCH DIRECTIVE, IN VIOLATION OF FLORIDA STATE STATUTE 316.1935(2); AND DID OPERATE A MOTOR VEHICLE ON THE ROADWAYS OR HIGHWAYS OF THE STATE OF FLORIDA WITH WILLFUL AND WANTON DISREGARD FOR THE SAFETY OF PERSONS OR PROPERTY, TO WIT: DROVE AT A HIGH RATE OF SPEED, PASSING NUMEROUS VEHICLES IN THE GRASS ON THE RIGHT SIDE, WHILE FLEEING FROM A LAW ENFORCEMENT OFFICER; IN VIOLATION OF FLORIDA STATE STATUE 316.192(1)(B). ON 101214 AT APPROXIMATELY 1305 HOURS, I WAS CONDUCTING PATROL IN THE AREA OF WEST DUNKLIN STREET AND NORTH DALLA TERRACE. WHILE DOING SO, I OBSERVED A GREEN IN COLOR FORD RANGER, BEARING FLORIDA TAG 825MMX, TRAVELING WESTBOUND ON DUNKLIN STREET TOWARDS MY LOCATION AT WHAT APPEARED TO BE A HIGH RATE OF SPEED. I ESTIMATED THE VEHICLE'S SPEED TO BE APPROXIMATELY 70 MILES PER HOUR (MPH). A T THAT TIME, I ACTIVATED MY AGENCY ISSUED RADAR, WHICH REVEALED THE SPEED TO BE 67 MPH IN A 50 MPH ZONE. AS THE FORD RANGER PASSED MY MARKED PATROL VEHICLE, I OBSERVED A WHITE MALE DRIVER OPERATING THE FORD RANGER. AT THAT TIME, I TURNED MY PATROL VEHICLE AROUND AND ATTEMPTED TO GET BEHIND THE FORD RANGER IN ORDER TO INITIATE A TRAFFIC STOP. UPON DOING SO, I OBSERVED THE FORD RANGER TO INCREASE SPEED AND ALSO PASS SEVERAL OTHER VEHICLES. I OBSERVED THE FORD RANGER TO PASS VEHICLES ON BOTH THE LEFT SIDE OF THE ROADWAY AND IN THE GRASS ON THE RIGHT SIDE OF THE ROADWAY. AT THAT TIME, I INITIATED MY OVERHEAD LIGHTS AND SIREN AND BEGAN PURSUING THE FORD RANGER. I ADVISED DISPATCH THAT I CURRENTLY HAD A VEHICLE FLEEING FROM ME, AND IT WAS TRAVELING WESTBOUND ON DUNKLIN STREET TOWARDS CITRUS AVENUE. I OBSERVED THE FORD RANGER PASS ANOTHER VEHICLE AS IT CAME TO THE INTERSECTION OF DUNKLIN STREET AND CITRUS AVENUE. THE FORD RANGER THEN TURNED RIGHT AND HEADED NORTHBOUND ON CITRUS AVENUE. WHILE ATTEMPTING TO CATCH THE FORD RANGER, I OBSERVED IT TO PASS TWO MORE VEHICLES IN THE GRASS ON THE RIGHT SIDE OF THE ROADWAY. I ENDED UP CATCHING THE FORD RANGER IN THE AREA OF NORTH CITRUS AVENUE AND WEST HONEYBEE LOOP. UPON GETTING BEHIND THE FORD RANGER THERE, OUR SPEED WAS APPROXIMATELY 85 MPH, WHERE IT TRAVELED FOR APPROXIMATELY 100 MORE FEET AND THEN STOPPED ON THE RIGHT SIDE OF THE ROADWAY. AT THAT TIME, I ADVISED THE DRIVER/DEFENDANT, LATER IDENTIFIED AS MR ZACHARY MASSEY, TO PUT HIS HANDS OUT OF THE WINDOW, TO WHICH HE COMPLIED. I THEN APPROACHED THE FORD RANGER AND PULLED THE DEFENDANT OUT BY HIS LEFT ARM AND PLACED BOTH OF HIS HANDS BEHIND HIS BACK. I HANDCUFFED THE DEFENDANT DOUBLE LOCKED BEHIND HIS BACK. HE WAS SEARCHED AND I WAS ABLE TO LOCATE HIS WALLET BEARING A FLORIDA DRIVER'S LICENSE BELONGING TO HIM. THE DEFENDANT WAS PLACED IN THE REAR OF MY PATROL. THE DEFENDANT WAS READ MIRANDA FROM A PREPRINTED CARD. HE ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH ME AT THAT TIME. I ASKED THE DEFENDANT WHY HE HAD RUN FROM ME, TO WHICH HE ADVISED THAT HE WAS ON PROBATION AND HE WAS ON HOUSE ARREST AND HE KNEW IF I PULLED HIM OVER HE WOULD BE GOING TO "JAIL." HE THEN ADVISED ME THAT HE THOUGHT IT WAS BEST TO GET DOWN THE ROAD AWAY FROM ME AND PULLED ONTO A SIDE ROAD SO I COULD NOT FIND HIM. THE DEFENDANT WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR FLEEING AND ELUDING AND RECKLESS DRIVING. THE GREEN FORD RANGER WAS TOWED BY ADVANCED TOWING. A TOW SHEET WAS FILLED OUT BY DEPUTY POLLIARD (1288). THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. WHILE AT THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT WAS ISSUED WRITTEN, NUMBER 371822B, FOR THE 67 MPH IN A 55 MPH ZONE. THE DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION (UTC) NUMBER 7858HBH3, FOR THE FLEEING AND ELUDING AND UTC NUMBER 7859HBH4, FOR THE RECKLESS DRIVING, BOTH WITH CRIMINAL VIOLATION COURT APPEARANCE DATES TO BE 110614 AT 1300 HOURS AT THE CITRUS COUNTY COURT HOUSE. THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $10,000.00 FOR BOTH CHARGES. |
