Comments: | Sex offenders have always lived in our communities; but it was not until passage of the community protection act of 1990 (which mandates sex offender registration) that law enforcement even knew where they were living. In many cases, law enforcement is not able to share that information with you. Citizen abuse of this information to threaten, intimidate or harass registered sex offenders will not be tolerated. Further, such abuse could potentially end law enforcement's ability to do community notifications. We believe the only person who wins if community notification ends is the sex offender, since sex offenders drive their power through secrecy. According to official documents, Poffenberger pled guilty on 12-14-2013 to the Crime of Child Molestation in the 2nd Degree and was given a term of 20 months in prison. The victim in this crime was a 13 year old female who had ran away from home. The victim and another person had taken a bus to Seattle and met the Suspect "Smiley" (Poffenberger) at the Westlake Center and offered to take them to a pawn shop to pawn some jewelry that they had but it was closed. All three got a motel room with three beds. The victim's friend fell asleep that which time Poffenberger got into bed with the victim and tried to remove her clothes. The victim resisted him, but he was able to remove her clothing and sexually assaulted the victim. Once Poffenberger fell asleep, she was able to leave the room and was found on Aurora Ave walking in the middle of the road and appeared distressed and was crying. The police were called and the Suspect was arrested. Poffenberger is on active supervision with the Marysville Office of the Department of Corrections. 360-658-2150. " Probation Conditions Report to and be available for contact with the assigned CCO as directed. Work at DOC approved education, employment, and/or community restitution. Not possess or consume controlled substances except pursuant to lawfully issued prescriptions. Pay supervision fees as determined by the DOC. Receive prior approval for living arrangements and residence location. Not own, use, or possess a firearm or ammunition. Notify CCO of any changes in address or employment. Upon request of the DOC notify the Department of court ordered treatment and; Remain within geographic boundaries, as set forth in writing by the DOC Officer or as set forth with SODA order. Obey all municipal, county, state, tribal and federal laws. Have no direct or indirect contact with the victim of this offense. Within 30 days of release from confinement obtain a sexual deviancy evaluation with a state certified therapist approved by your CCO and follow through with all recommendations of the evaluator. Should sexual deviancy treatment be recommended, enter treatment and abide by all programming rules, regulations and requirements. Attend all treatment related appointments (unless excused); follow all requirements, conditions, and instructions related to the recommended evaluation/counseling; sign all necessary releases of information; and enter and complete the recommended programming. Obtain prior permission of the supervising CCO before changing work location. Abide by a curfew of 10:00 p.m. to 5:00 a.m. unless directed otherwise. Remain at registered address or address previously approved by CCO during these hours. If a resident at a specialized housing program, comply with all rules of the housing program. Consent to DOC home visits to monitor compliance with supervision. Home visits include access for the purpose of visual inspection of all areas of residence in which the offender lives or has exclusive/joint control/access. Be available for and submit to urinalysis and/or breathanalysis upon the request of the CCO and/or the chemical dependency treatment provider. Submit to and be available for polygraph examination as directed to monitor compliance with conditions of supervision. Register as a sex offender with sheriff's office in the county of residence as required by law. Obtain chemical dependency evaluation upon referral and follow through with all recommendations of the evaluator. Should chemical dependency tretment be recommended, enter treatment and abide by all program rules, regulations and requirements. Sign all necessary releases of information and complete the recommended programming. |
