SUBMITTED BY: DIXON, MEREDYTH 0108 (AR11119688) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: OVER 20 GRAMS OF MARIJUANA, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A DIGITAL SCALE AND GLASS SMOKING PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 030811 AT APPROXIMATELY 2215 HOURS, WHILE TRAVELING SOUTHBOUND ON TURNER CAMP ROAD, I OBSERVED A VEHICLE TRAVELING AT A HIGH RATE OF SPEED. I THEN CONFIRMED WITH MY RADAR THAT THE VEHICLE WAS TRAVELING AT 60 MILES PER HOUR IN A 45 MILE PER HOUR ZONE, AT which TIME I INITIATED A TRAFFIC STOP AT TURNER CAMP ROAD AND SHERRI LANE. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, MR ZACKARY STANFIELD, I REQUESTED HIS DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE. I ADVISED THE DEFENDANT THE REASON FOR THE TRAFFIC STOP WAS DUE TO HIM EXCEEDING THE SPEED LIMIT. AT THAT TIME, I COULD SMELL A DISTINCT ODOR PROTRUDING FROM the VEHICLE THAT SMELT LIKE MARIJUANA. I THEN ADVISED DISPATCH TO HAVE A CANINE RESPOND AS I WROTE A WRITTEN WARNING and CONDUCTED A FIELD INTERVIEW WITH THE OTHER TWO PASSENGERS IN the VEHICLE. AT THAT TIME, DEPUTY DEARDEN AND CANINE TYSON ARRIVED ON SCENE. I ADVISED DEPUTY DEARDEN THAT I HAD RETURNED THE DRIVER'S IDENTIFICATION AND GAVE HIM A WRITTEN WARNING, BUT WAS STILL CONDUCTING A FIELD INTERVIEW REPORT (FIR) WITH THE OTHER TWO PASSENGERS. I ALSO ADVISED DEPUTY DEARDEN OF THE SMELL OF MARIJUANA. DEPUTY DEARDEN THEN MADE CONTACT with THE DRIVER AND OTHER TWO OCCUPANTS OF THE VEHICLE, AND ADVISED THEM TO ROLL UP THE WINDOWS SO THAT THE CANINE COULD CONDUCT AN EXTERIOR SNIFF OF THE VEHICLE. WHILE CONDUCTING THE EXTERIOR SNIFF CANINE TYSON GAVE A POSITIVE ALERT ON THE VEHICLE. TYSON WAS THEN PLACED BACK IN DEPUTY DEARDEN'S PATROL VEHICLE AND THE DRIVER WAS ASKED TO EXIT HIS VEHICLE. DEPUTY DEARDEN MADE CONTACT with THE PASSENGERS AND HAD THEM EXIT THE VEHICLE. UPON THE PASSENGERS EXITING THE VEHICLE, THEY HANDED DEPUTY DEARDEN A CIGARETTE PACK AND THE DEFENDANT STATED THAT THEY WERE HIS CIGARETTES AND HE HAD JUST PURCHASED THEM FROM A FRIEND OF HIS. DEPUTY DEARDEN THEN SEARCHED THE CIGARETTE PACK AND FOUND AN UNKNOWN TYPE OF PILL WRAPPED IN A PLASTIC WRAPPER. DEPUTY DEARDEN THEN CONDUCTED AN INTERIOR SEARCH OF THE VEHICLE WHERE HE FOUND IN the CENTER COUNSEL, SIX INDIVIDUALLY PACKAGED PLASTIC ZIPLOC BAGGIES CONTAINING MARIJUANA, AS WELL AS A BLACK AND SILVER DIGITAL SCALE AND GLASS SMOKING PIPE. THE DRIVER OF THE VEHICLE WAS THEN PLACED UNDER ARREST, HANDCUFFED DOUBLE LOCKED BEHIND HIS BACK AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. HE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. the DRIVER'S VEHICLE WAS REMOVED FROM the SIDE OF THE ROADWAY BY HIS STEPFATHER WHO LATER ARRIVED ON SCENE. UPON ARRIVAL AT the DETENTION FACILITY, THE DEFENDANT WAS READ MIRANDA VIA A PREPRINTED CARD, AND WAS ASKED IF HE WAS WILLING TO SPEAK TO this DEPUTY IN REFERENCE TO THE MARIJUANA THAT WAS LOCATED IN the VEHICLE. THE DEFENDANT STATED THAT THE MARIJUANA DID BELONG TO HIM, AND THAT HE HAD PURCHASED IT A FEW DAYS AGO. THE DEFENDANT ALSO STATED THAT HE WAS ON PROBATION FOR CHARGES OF DRUG PARAPHERNALIA. THE DEFENDANT WAS THEN PROCESSED AND CHARGED WITH ONE COUNT OF POSSESSION OF MARIJUANA OVER 20 GRAMS AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA. THE DEFENDANT'S TOTAL BOND WAS SET AT $5,500.00, PER THE BOND SCHEDULE. ALL EVIDENCE WAS TURNED IN TO A CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE LOCKER.
