Probable cause affidavit: submitted by: williams, robert 0714 (ar12-236) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, DOLLAR GENERAL STORE, TO WIT: STOLE COLD AND FLUE MEDICINE AND A RED BULL DRINK, SAID PROPERTY BEING OF A VALUE OF $7.50 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(a). ON 030812 AT APPROXIMATELY 0930 HOURS, I WAS DISPATCHED THE GENERAL DOLLAR STORE LOCATED AT 3042 SOUTH FLORIDA AVENUE IN INVERNESS IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE MANAGER/COMPLAINANT, mr krewson, WHO ADVISED THAT ON TODAY’S DATE, 030812, HE OBSERVED THE DEFENDANT, mr michael guarrera, ENTER THE STORE AND BROWSE SEVERAL ITEMS FOR A SHORT LENGTH OF TIME. MR KREWSON THEN ADVISED THAT THE DEFENDANT APPROACHED HIM AND ASKED HIM IF HE WAS HIRING. MR KREWSON ADVISED THAT HE OBSERVED THE DEFENDANT TO HAVE WHAT APPEARED TO BE A SODA CAN CONCEALED in THE POCKET OF HIS PANTS. THE COMPLAINANT ADVISED THAT HE HAD ASKED THE DEFENDANT WHAt it was and the DEFENDANT retrieved an unopened can of red bull and told the COMPLAINANT “i’m sorry” and gave it to the COMPLAINANT, at which time, the COMPLAINANT contacted this agency. the COMPLAINANT agreed to complete a sworn written statement, which was turned in to the CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. the COMPLAINANT also advised that he would contact this agency at a later dater when the SURVEILLANCE video was available. i then made contact with the DEFENDANT and IMMEDIATELY read him miranda warning. the DEFENDANT stated that he understood his rights and wished to speak with me. the DEFENDANT stated that he is currently homeless and unemployed and that he was thirsty, so he came inside the store and attempted to steal the can of red bull. i then placed the DEFENDANT under arrest, handcuffed (DOUBLE LOCKED) behind his back. prior to searching the DEFENDANT, i asked him if he had any further stolen MERChandise in his POSSESSION, to which he advised “nope”. i then searched the DEFENDANT and located two dollar general brand cold and flu medication, which were located inside the rear side of his pants, which were valued at $2.00 each. the DEFENDANT first advised that he had purchased the medication at another dollar general store; however, retracted his statement and advised that he did attempt to steal the medication from this store. the DEFENDANT was then secured in the rear seat of my patrol VEHICLE and transported to the CITRUS COUNTY DETENTION FACILITY (CCDF) for booking and processing. the DEFENDANT’s bond was set at $250.00 per the bond schedule. an agency case card was provided to the COMPLAINANT bearing this case number and my information. the COMPLAINANT was advised to contact this agency with any further information.
